i only had one phone call to be fair from mint.

once i told them i was in a iva, the woman said thats fine ill make a note of it on the system and they never called back...

but then again, thinking about it, mint are the only ones who have my new moby number!
lots of payments to go.

Having gone down the BR route- only a week ago - I got my first call on Friday eve ----

"You have not made your payment"
"No, I know, I am unable to do so"
"Can you make the payment today?"
"No, I do not have the money to make the payment - I was declared BR on 1 October, this is the number in ****** County Court"
"Can you borrow the money?"
"No, I am not allowed to borrow money from anyone"
"Can you use your credit card?"
"As I am BR, I do not have a credit card"

What planet are these people on???

Sadsack's experience just shows the general lack of knowledge about insolvency,both bankruptcy and IVAs with call centre staff employed to extract payments.What is concerning is the wrong info that is given out by these people resulting in Joe Public making payments that they simply can't afford.Banks need to monitor these calls and check on them because I'm sure that they would be appalled at what they heard.
Maybe they don't want to know !!

lol, they really do need a bit of training! How to listen would be a good start.
Perhaps cutting out the middleman and demanding to speak to the manager would help! I avoided all mine on advise prior to the creditors meeting. After that I didn't mind speaking to them unless they called at work.

A few of them have called now

The following have been friendly and polite and simply noted that we were applying for an IVA

First Direct, Egg, Amazon(Halifax)

Goldfish as discussed were horrendous

HSBC, some bloke in a muffled foreign accent asked me why I had not made payment. I explained that I was entering into a IVA

'So I mark you as bankrupt then'

'No an IVA'

'I understand vely well, bankrupt yes'

And then Sygma bank, some lad who sounded about 13 rang up and had never heard of an IVA

Hmm

Well Goldfish are pretty relentless

Their latest tactic is to ring me 2 or 3 times and tell me they will vote no to my IVA because i've used the card several times in the last few months before i started missing payments and that is irresponsible borrowing.

However if I was to make a token payment, then that would greatly increase my chances of success apparantly [|)]

Ah yes Goldfish. They used the same scare tactics with me... the phone call a nice scottish voice. Once he realises he won't be getting any money from me passes me to the 'supervisor' Much of the same palaver threats entreaties etc. I stopped answering their calls so they called my work (see this thread)

After advice from members of this Forum I took more direct action. I agreed to contact them daily. After doing that for a few days they agreed to a call every 2 days and then weekly. They voted yes at my creditors meeting even though they said they would be voting no because I had apparently used my card when I knew I could not pay it back

That's interesting and reassuring really that my call matched yours entirely from the friendly Scottish accent to being passed to the more agressive supervisor demanding payment

Hopefully I will have the end outcome from them as you ! :)

I will try contacting them daily to see if that keeps them quieter

It must cost them more in phone calls and manpower than it's worth!
Just think how much they could save with proper training! Then they wouldn't be quite so desperate!!!

They prey on newbies (by newbies I mean debtors who have met every payment all their lives and are experiencing the guilt of having missed their first payment!) That was me not long ago!

I've had them all - from really very helpful people, to one right obnoxious (insert expletive of choice) from Barclays who phoned me every day for 2 weeks 4 or 5 times a day and was downright offensive and extremely agressive and rude.

After 4 days of being polite, I just started telling him to stop harrassing me because whilst I fully respected that he could hold his opinion that I was (in his words, I kid you not) "a lying waste of space", I felt that the minute I played the recorded phone call of our conversation to the banking ombudsman and to my lawyer, he may well lose his job and be sued for harrassment. Oddly enough, the calls stopped after that.

If situations in my previous employment didn't intimidate me (enforcement immigration officer working with the police in South london), a snotty rude creditor on the end of a phone sure as hell won't!

I have read many many thread about creditors calling and the stress it causes.

In my opinion once each creditor has called once and you have notified them that you are BR/in an IVA or about to propose an IVA, any further phonecall is a nuisance call.

I was under the impression that BT were able to issue you a new number on your phoneline and deactivate the existing number.

Granted it is a pain telling people your new number, but I would rather do that, then have to have the flash of pain that goes through your stomach when the phone starts to ring.

I recently moved house and had new mobile and BT number issued, so *touch wood* there is very little chance that any creditor will be able to track my number down.

I get the pain as I see the post come through the door, but at least I know then, once i've braved opening the post, I can get on with my day.

I changed my home phone number. I just got post which i can deal with. I understand that they are just chasing what is rightfully theirs, but there is no need to be rude and aggressive in the process.
