Good morning, i hope someone can give me some advise, i have searched through the website to try to find the process for a Full and Final situation, my OH and i agreed a full and final from day one last year july 07, doing a remortgage and selling of endowment policies, mine has (as far as i know) gone through okay whereas my OH iva has had a very major setback, what is the process for my iva as there where no problems with mine, process being;

when do the payments get paid to the creditors?

when should i receive any confirmation from my IP?

how long does my name stay on the insolvency register?

how much contact from an IP is deemed as reasonable?

I am assuming that you are already in an IVA? What term was the IVA to run over, and have you enquired from your IP the likely date that they will be completing matters for you? Creditors will likely get paid when they send out their final report, which will be copied to you along with your Certificate of Due Completion.

Your name will be removed from the Insolvency Register a couple of weeks after the Registrar has been informed by your IP. You need as much contact with your IP as you deem reasonable - there are no hard and fast rules.

Sorry Blue, can I just jump on here a minute. Melanie, if you just do a lump sum IVA as I am hoping to do, does your name go on the insolvency register and if so for how long? Thanks. Viki X

Yes - all people who enter into IVAs have their names listed on the Insolvency Register, and they are removed once the case is finalised.
