gas supplier took out my gas meter

hi i entered into an iva that began on5th june 2007 but my gas supplier bes took out my gas meter as they said the gas bill they sent on june 8th for gas consumed in may was not included in my iva.

abbey taylor who are my iva supervisor say that this is not correct and bes have committed an illegal act and should not of removed the meter. i have asked abbey taylor if they can help me seeking legal advice as i want to take bes to court to get my meter put back as they want £1600 before they will do this but i dont want to spend money on asolicitor if i not going to win and abbey taylor say they have no legal expertise this dissapoints me as i feel they should be doing more to help me does any have any advice for me please .

I think that it is very difficult to include utility debts in to an IVA because there are a number of "sanctions" that a utility supplier can apply, perfectly legally, even if the debt was included in the IVA. One of these is removing a meter and insisting on prepaid use.Another is asking for a large deposit to secure further supplies.

Included in the IVA, or not included, I think that you have a problem here.

Advise to anyone setting up an IVA.
Use the time when you are no longer paying your unsecured debts [whilst awaiting your creditors meeting]to get "upto date" with your utility bills and council tax.

Prority debts and Non prority debts are different.The former is always inportant to satisfy as service restrictions and sanctions can be carried out.

I think its best when having gas, electricity arrears to come to an arrangement where as you pay an extra amount per month till the arrears are paid off. This way there is no chance of them cutting your gas/electricity off all together.

i had a key meter fitted. and i owed them a little bit of cash, they said they will deduct 5 pound per week from my meter until the debt is paid.
