Getting married to someone in an IVA. Need Help.

My partner is currently in an IVA and is about half way through it.

We are getting married later this month (civil partnered being the official term lol) and now the company that are administering his IVA have told us that they now need my full income and expenditure to take into account.

Given that he has already been in the IVA for 30 months and therefore he has already signed to and agreed a settlement plan, do the company have any legal right to have this information or indeed, start taking money off me too? (I already pay money as my share of the mortgage etc to my partner which is taken into account in the IVA)

Hi,

Congratulations on the upcoming happy event.

I imagine they just want to make sure that you both paying your fair share into the household expenses.

I presume you have lived together for a while?

Hi Niobe, thanks, tis very exciting.

Yeah we have lived together for a while now and I make a 'fair share' contribution which they approved when he started the IVA. Now they are saying that because we are getting married that they may be able to take more and therefore need to see all my income and expenditure.

I just wanted to make sure of my rights really because legally, surely they can not force me to pay anymore than the 'fair share' contribution that I already am?

Congratulations to you both.

My understanding is they will use your income to help calculate the % paid into the household expenditure to determine your partners IVA payment. They will need your outgoings as well to establish what level of disposable income after all your outgoings to help inform them of the correct % to be aid by your IP.

If i have read this correctly and you have been living together for a while and you contribute to the household etc which the IVA company know about and have acknowledged it within your partner's icome & expenditure then what difference does is make if you are getting married? Just because you are getting married, changing your name etc doesn't mean you have to increase your contributions, surely!

IVA COMPLETED August 2012, received Completion certificate 18.4.13.

That is very kind of you.

Get the latest. Because my partner and I are going to be changing to a double-barreled surname. He enquired about how to go about it and so on. They (the providers, are they called IPs???) have spent a week saying that they are still 'finding out' and are now saying it will cost him £557 to go to the courts and the creditors to have his name changed on the IVA documentation. They are saying that is the amount it will cost because of the administration and paperwork involved... Really? Ironically that is the exact same amount that he pays per month for the IVA.

Does anyone have any experience of this? Im guessing that they are just plucking numbers out of thin air as such rather than actually finding out.

Of course, he isn't allowed to contact the creditors so he cant just call them direct to sort the name details out but surely it is no different to if you change your name on a mortgage for instance, which is FREE!

Any advice greatly appreciated.

Oooh I'm surprised I would have just thought you have your ceremony (assume you get a certificate) and forward it to whomever to change names??

Maybe Melanie,Michael or another professional can comment on this as I'm sorry I've no idea x
