well as you know with me nothing is ever straight forward, finally got hold of the OR this morning and boy am i glad that i did, she said whats the problem can you not raise the BI said no had no one else who could either, she said can you not raise the £211 + £1, said sorry don't understand, she said we have had the mortgage statement back from NR and you are in negative equity we have done a drive by basically you owe NR £132k and the valuation we have got is £130k, i said that means that NR have secured the loan then she said it looks that way, i said are you sure, got her to repeat it to me 3 times, she said get a letter to me straight away saying that you do maintain the interest in the house, so have done that registered it, i can't believe it we can hopefully keep the house all being well, she said only need to raise the £211 and the £1, so please everyone keep your fingers crossed that this doesn't turn bad for me, don't even know whether i should post this incase they are reading (NR) and they change it but she said thats what she had on her screen and that was that.

i have asked NR last month if i can go on to repayment only hope this doesn't affect it, it was only to be short term anyway.

Did the OR tell you when the debt was secured?

no she didn't melanie thats why i dont' want to build my hopes up to much, but she said to me today all they were looking at was the fees of £211 and the £1 as it was in negative equity she just said the statement from northern rock in regards to the mortgage was £132k, i asked her 3 times to make sure that all i would have to pay was the £211 and she said yes, i have a mortgage statement which says the outstanding mortgage balance is 105k and then the unsecured amount is seperate but then a total figure, my statement is a couple of months old. so i can only presume thats where the higher figure comes from, as the penalties in finishing the mortgage would not come to that much.kerri

thanks everyone for your replies, have mixed emotions at the mo as i just don't understand, she never definitely said the unsecured part had been secured just that the amount from northern rock was higher than the value of the house, i really hope this is right, but still don't understand where it has come from if it isn't the unsecured loan part of the together mortgage, i remember at the very beginning of my iva journey a few companies said to me that they would be very surprised if the unsecured part of the mortgage was not actually secured and that i would find when any difficulties arise with payments they automatically secure it, waffling i know, just keeping fingers crossed.

Please promise me that you will get this looked at by a lawyer. I don't want you to have any false hopes or nasty suprises in the future, and you do need to check the date that NR secured the debt. If this was after the bankrutpcy order, then it is invalid.

hi melanie thanks for the reply, i don't want to get my hopes up to much as i would be awfully disappointed, will wait for the paperwork to come through and go and take legal advice once i have something in black and white.
