I have to spat now because i am really angry!!!!
I was made bankrupt on 21 June 2007. Nothern Rock had passed my personal loan to Wallers Solicitors to recover. Now I kept in touch with them all the way to advise the process and that i was being made bankrupt. Wallers even called Northern Rock to tell them i was being made bankrupt but they said proceed. I received CCJ papers through and i called to the solicitor and advised i had been made bankrupt. They told me that they would close the file. I actually sent the papers back to the court with a copy of the bankruptcy order by recorded delivery (the royal mail have confirmed delivery) I called Wallers this afternoon and they advised me that they had closed their file.
I called the court to confirm that they had had the papers, they advised NO!!!!! however they would require Wallers to formally withdraw proceedings, Wallers have just closed their file and left it. Surely if they issued proceedings they cannot just leave it to get a judgement in default knowing for well that i have been made bankrupt and it isn't legal?
Any advice would be appreciated - do i complain to a higher body = if so who????
Thats it rant over!!!!!!!!!!!!!

Hi Zoe

I understand your concern, but having a bankruptcy registered against you is far worse than a CCJ. If you are really concerned about this contact the Official Receiver who will deal with this for you - but it really is nothing to worry about.

Thanks Melanie,
I just feel that i am sorting all this out for them rather than the solicitors who should have done this and cancelled it. I read Rachels post and saw that a charging order had been made and then it seems alot to sort out so i am trying to do this before it gets that far!

Zoe

I know how you feel but turn the problem on it's head NR have wasted a lot of money in legal fees by pursuing this.

I think they have wasted a lot of money on this isue especially as you declared yourself bankrupt!

Take care

Ray
