GT - again - EIC - 9 months closure

Hi all

First post here but I've read a lot already.

Started with Accuma Nov 2006, Made my final payment in November 2011, and advised would take 'up to 5 months' for closure... nearly nine later, and still no CC from GT.

Rang last week and emailed closures to be told the ususal 'we need to request refund due to incorrect amounts being paid after duplicate claims by creditors'.

I asked for an update, to be advised that the refund had been requested in March; but that GT had resubmitted the request last week when I chased them (but not before? After nearly 5 months? Not good).

Get home today, and have the EIC letter waiting for me - dated 19th with 10 days to respond, which means tomorrow, a Sunday. Anyway, rang and left a message with the switchboard to say I'm not happy with the situation, but I'll ring back on Monday.

My worry is, it's already taken nine months and I've heard NOTHING from GT in that time. I've chased them up, to find that they've done something back in March and then sat on the case for months doing nothing.

Now I'm being told by the switchboard that if I don't let EIC get involved my IVA will be failed. That doesn't seem fair when I've made all the payments and done everything I've been asked.

I never took out PPI, and wasn't charged much by any of my creditors unfairly as I paid them all almost always on time until I took out the IVA and didn't incur much in the way of charges as a result, so I'm concerned about EIC wasting a load more time.

If GT had closed my case when they said they would (in the original 5 month timeframe) or even opened the EIC proceedings during that timeframe, I might be able to move on, but now I'm faced with an even longer closure period and another ruined weekend worrying about what's going to happen.

Closures have at least responded to my emails but haven't given me any indication what's still to do in closures, what stage of the process I'm at, how long it will take, or what to expect. All I've been told is they'll contact me again in three weeks.

I've been waiting nine months, isn't it about time I was allowed to move on with my life?

We finished our last payment in Oct 2011, full and final settlement, we were also told 5-6 months for the completion certificate. When we queried where it was a couple of months ago, we got the same answer as you, "overpaid creditors", etc. Then last month we emailed them to see what was going on, they said it had all been sorted and that we should get it in 4 weeks (on May 22nd), still no certificate and the EIC letter landed on the 19/07/2012, although they haven't mentioned that if we don't take it up we will fail the IVA, don't see how when it was F+F settlement, we intend to ring them on Monday to see what is going on! Is there any professionals who know what this is all about and wether they can fail you for not going with EIC?

Same letter recieved yesterday - I will be on the phone to them too Monday, why do these letters always turn up in a weekend?

IvaNotOverYet your story is identical to mine. I started out with Accuma in Nov06 and have been told that incorrect amounts had been paid and they had to request a refund. But they only told me this last month when I chased them up. What have they been doing since Dec 11 when I paid my last payment? Nothing it seems. And this letter on top it all is too much to bare.

Well I've realised after a ruined weekend worrying about this that there's not much point calling GT this morning as I can't actually speak directly to Closures so I've emailed them again this morning and asked the questions:

•Should I have been told that my IVA is going to fail if I don't let them have my details? It doesn't say that in the letter.
•How long will the EIC process take and would that delay closures even further?
•Do I effectively have no choice but to allow EIC to get involved as if I say no you will fail my IVA?

Other than that, what do I do? I feel like I'm being held to ransom now - it seems that doing nothing on closures for months is a great way to find more and more ways to prolong the agony and find loopholes to exploit.

I don't know how to escalate this any more, I just keep getting told by Closures that it 'takes as long as it takes' and that doesn't seem right.

I'm really worried about my arrangement failing and having to go bankrupt. If I'd known that might happen after nearly six years of trying to do the responsible thing I'd just have done that in 2006.

At least I now know I'm not alone - and I see Grant Thornton have been answering other questions on this topic today so maybe I will get some help soon.

Don't know if this will help anyone, but I have heard back from GT closures and they have told me that I can indeed opt-out on the basis that I declare that I believe I have not been unfairly charged (which I do believe) and that I declare I will not pursue a claim at any point (which I won't as I just want to move on now).

I don't know if that will be the same situation for everyone but I hope it might be of use to someone to know the answer I've had in any case.

First thing this morning Michelle, before 9am. I had already been having a dialogue with one of the Closures team though so maybe it went to someone specific instead of a general mailbox?

Yeah same here - I have been in regular contact with Olivia over the last 3 months so I emailed her, but not heard nothing back.

I have just received an email from Olivia and the EIC letter is not just for anyone in an IVA. As far as I can see even though after 9 months from last payment they still want EIC to do the charges recouperation. Oh well guess I will get my CC when I get it !!!!!

I know that there is bad press on GT and I am the first to come up and defend them and Karol who has been a star!! But like the others received a letter on friday dated the 19/7 for 10 days to respond???? Disgusting comes to mind. I e-mailed them within the dead line no RESPONSE!!!!!!! Fuming GT!!!!! F & F accepted did not take Payment protection do not want my details given over fed up of the calls I get already.Just want my CC please GT you have let me down and I am sorry to say that as I have always stuck up for you!!!!Please sort it out it's bad PR!!!

I don's see how legally an IVA can fail if you don't want to engage in the reclaim for unfair bank charges, but my advice is to co-operate with your IP and ask them for a realistic timescale as to when you can expect your case to be closed.
