Hi Foggy, Harrysmummy78, thank for advice. Ours is the 2008 protocol as was taken out end of March 2010 it and our proposal refer to the equity as 5k each no mention at all of it being 5k jointly.
We feel Gt are trying their luck and hoping we cave in!

I fear, as the big boys get bigger, they are becoming the playground bullies too. I can envisage a time when they have the playground all to themselves and can carve up the insolvency industry between them.

Certainly seems this way Foggy, very frustrating when we are almost there.
can we complain via the link provided without having to refer back to Gt?
also as ladt payment is Weds what do we do about attempting remortgage? Dont want to get accused of failing iva by not complying but equally dont want to do something that is not needed.

GT's complaints procedure itself is three months long (which I feel warrants a complaint about that ! )and you have tried several times to get your point across, so I feel that the Gateway could be used right away, without referring back to GT.

In your shoes I would still try to get a couple of remortgage refusals -- after all you won't get a remortgage.

Thanks Foggy, will get the refusals and send them in. Will look at complaining to the gateway tomorrow and see what happens.
would be nice to be able to find someone who had the same problem with Gt and came out winning it least then we'd be proved right but until then we fight on!

Current lender is usually favourite. Hopefully a few who have been there will chip in with their experiences. What you want is a lender that will refuse online, then you just grab a screenshot.

could I suggest that in your letter to the gateway you include:

copies of your agreements
copies of the protocols you are bound by
copies of GT response that confirms they have Been treating everyone else's interlocking IVA's in contravention to proposals and protocols.

Your valuations

I would also copy in

CEO of GT asking if he know this is going on

Chief exec of CAB asking why they only recommend one IVA firm especially when they are breaching protocols and proposals

I would also ask the regulator/gateway that in the interest of consumers and the CAB it may be necessary for GT to undergo and audit by an external firm of all interlocking IVA's as they may have mistakenly taken hundreds if not thousands of
pounds from clients through potentially questionable practises which don't comply with legislation.

all it takes is for one person to blow the Lid on companies there are taking how public To the cleaners !!

I imagine your case would get resolved pretty quick !! It is unfortunate to have to require such drastic lengths, this is the kid. fo case/question that brings the crap to the surface and differentiate the firms that act as they should and those that shouldn't.

Thanks very much for your reply I was putting together a letter to the gateway so will include all you suggest.
I hadn't though of copying the CEO of GT but think that is a great idea maybe he/she will put a stop to this.
I agree that if it stops others who are not lucky enough to have the help of a forum like this paying more than they need it is worth the fight.
I notice from previous posts on here almost everyone else seems to use the 5k de minimis each just our luck to get the one that dose not!!

I think that's the points, doesn't your agreement/proposal/guidelines say £5k each and they are 'ignoring' that bit !? Which forms the main crux of the argument,

Hi Longslog101, Yes we each have a proposal and each one refers to say your share of equity. At no point does anything mention shared it all refers to your share.
This has been raised repeatedly but they still insist it is shared and not each!!

Hi sorry further question.
Just done online application for remortgage and as expected got a sorry lending decision declined response.
Do I just need to print and send that decision page to Gt or do I have to send the entire application?
Sorry not sure what they actually need.

IPs do differ in their requirements, but the refusal page tells them all they need to know in the current climate. If remortgaging was remotely possible they might want figures (or, if they were just being b***** minded!)
