That is fairly clear in written script, but less so in interpretation!

It gives the Supervisor discretion to set the payments higher at annual review stage, subject to their own discretion, and also talks about you having to pay over 50% of additional income - but I feel you could interpret that as disposable income rather than top line income, on the basis that it makes no allowance for increased expenditure, which generally rises at the same rate as salary.

The main thing Melanie is i will still be able to pay the agreed minimum monthly payment into my IVA as long as i can do that they should'nt complain really should they ?

thanks for your response Melanie, the company I am with is called FA Simms, I still have not received a reply to my email or calls. I just tried them again this morning and I was told that my supervisor is not in again today until 2pm. Last time I rang I was told that he was at lunch and he would call me back. They seem to be unscrupulous, they were very quick to increase my payments etc but now that I am asking for a face to face meeting no-one seems to be bothered to get back to me. Is there a place I can complain to? I am now stressed out about this as I feel that if my IVA fails they will be the only ones to benefit from my failure

Melanie, I have just sent an another email and done as you suggested, requested a delivery and read message notification. I have complained about the whole process. I initially emailed him on the 27th March which is about two weeks ago and no-one has attempted to contact me about the email or to even call me back considering I have been ringing them nearly every day. I just feel as if I am being a nuisance to them and that they keep on boffing me off with claims that the supervisor will call back. This is just so annoying, they are making a fortune out of my IVA and they dont even have the decency to ring me back. hrrrrrrrr

I agree with Melanie that that whilst the wording is clear, there is a discretion on the supervisors part. 50% of "additional income" could be net or gross - like Melanie if I were your Supervisor it would be net.

If you wanted to make a complaint it would be against your Supervisor personally. All IPs at the firm you mention are licensed by the IPA. The e-mail address of your Supervisor is available from here:

I would send your Supervisor an e-mail setting out your concerns and the fact that his staff have failed to reply to your requests for a meeting. Also indicate that unless your queries are addressed you will have to consider complaining to his licensing body. That will I can assure you, have an effect!

Thanks Ian, I have just got a call from them and the administrator has informed me that one of the Directors was on holiday so my IP was busy with his workload which involves corporate clients! I then informed her that while I understand that, they are not offering me free service and therefore should not be prioritising corporate clients over personal insolvency issues. I stressed that even a mere acknowledgement of receipt of email would have been sufficient with the purpose of informing me that my IP would get back to me in say about a week, instead of letting me call their offices every single day when they knew that he would not be able to deal with it anyway. I wish I could change IP's, this is about the third time where I have had to send second emails just to get a response. To say I am fed up with them is an understatement, thank you so much though Ian and Melanie for your very useful comments.

Dear FM's

Thank you for your support with regards to my post, just to give you an update. Well I sent out another email per Ian and Melanie's valuable advice and got a result, firstly they admitted to incorrectly calculating the figures so in a sense the extra income I earned had all been used up by other expenditures hence I did not have to pay them the £1344. Furthermore they had said they would increase my monthly payments by £60 to £360. This they also said was inaccurate and that there would be no increment this year. I am still stunned by all of this, if I hadnt challenged them I would have been paying about £469 a month for the rest of the year. Phew, in my third year and counting........

Hi batawi3,thats incredible really, i mean the people in charge of looking at your finances in your IP offices are obviously not qualified to do their job, you could easily have gone along with what they said & been none the wiser, well done for contacting them.

Had a call from my IP staff & they are quite happy with the new expenditure that i will have & only a small increase to my monthly payments too, i thought it was gonna be a nightmare, but i must admit the IP office staff who called me seemed friendly & helpfull, the only thing that im in disagreement to is about some back dated income i recieved which i supposed to have passed half onto my IVA, but i explained that this was offset my extra expenditure last year so the IP's staff took it on board & said will speak to my IP about it.
Other than that I am quite pleased with the outcome.

Glad to hear that PM5, I have just been informed that I will have another pay rise in June of approximately £200, which means £100 to my IP every month.....grrrrr!!! I am thankful though to have an extra £100 to use every month, it is better than nothing. I guess I could just put it in my contingency fund instead of spending it as I am coping just about ok without the increment
