OMG! Well you may have read my other post about getting 2 phone calls a day from Simply Be demanding payment, even though I have had an IVA since September.
Well I called Payplan and they said it was harassment and would get it sorted. Last night Simply Be called me AGAIN, but this time the lady said she was very sorry as it said on my notes that they were not allowed to contact me and was very polite.
Tonight I get a phone call from a different number and it was the collections team on behalf of Simply Be. The man on the end of the phone was so rude to me and said I was lying about my IVA as he knew nothing about it. I explained that the lady last night saw it on my notes and he just said I was lying again to get out of paying. After shouting at me 3 times asking me to make a payment he said that I was refusing to pay and that they are now going to take legal action.
I asked for his name but he just refused and said it was none of my business. Every time I tried to speak to defend my case he just interuppted and shouted at me in a very threatning manner.
I am going to call Payplan in the morning, but I am sat here physically shaking because he really upset me with his nasty tone.
I would just put the phone down- bullying Tactics -I know we feel guilty but remember the person calling has probably been programmed with what to say-learning myself how to deal with things like this!
I am so sorry that you are still continuing to get harrassment from these people. They cannot do anything to you at all.
Speak to Payplan tomorrow and tell them how this is upsetting you - they should be sorting this out.
If Simplybe continue then I would tell them to bring on the court action - it will cost them a fortune and you could probably claim compensation for the distress you have suffered.
They cannot do anything as you are fully protected by the IVA.

Sorry to hear they are being such pests ( I did type another word, but thought better of it!). If they ring again simply hang up on them. If they try to take legal action ( which they can't) they are going to look rather foolish in front of a judge. I can't remember who it was, but one firm went to court and the judge decided they had harrassed the borrower and wrote of the whole debt !!!

So sad to hear you are getting these calls SuperGert. Your IP need to take immediate action against simply be to stop them continuing with this abhorrent bully boy tactics. It doesn't matter what they threaten you with, you are protected by the courts. If they phone again tell them that you are recording the conversation (even if you are not), if they threaten you with CCJ or court action, etc. tell them that you have no intention of continuing the call and hang up. Try not to loose it and swear or raise your voice, this will convince them that you are recording the conversation. Good luck and I hope your IP gets these thugs off your back. Don't forget the members on here will always support you when a little TLC or advise is needed.

Personally, if it were me, I'd tell them to bring it on. They are going to be ones looking foolish.

I am fine now after treating myself to a glass of vino. Was just feeling very cross at the accusation of being a liar, when I have done nothing but be helpful and polite.
Hey-ho, lets bring it on and see the bullies lose ;o)
Tell them to take action and hang up. As Jan says, they will be the ones to look foolish and although it's upsetting at least you know they can't touch you.

Hi Supergert I am so sorry that you are having this hassle and hope that you can try your best to ignore it. If I were you I think I would just not answer the phone - get people you know to do a one ring then you'll know who it is or two rings then stop etc. Tell them you are getting nuisance calls if they dont know about your IVA. You do not have to answer your phone to anyone and at this stage if you do you are just putting yourself through unecessary grief. If you don't get it in writing ignore it. I don't agree with saying bring it on though it is very easy to say this as advice when you are familiar with protocols but I feel that this is not helpful to posters going through stress in my opinion. I also do not like advice saying I'd love them to take me to court I feel this is unhelpful and negative. However you could say I'll just get him... and then leave them hanging on forever they'll be less likely to call back soon. Hugs and stay strong.

Hi Oscar. I appreciate your comments, however, allowing them to take you to court (if you are up for it) is far from negative. As has happened in a previous case, the creditor was found to be harrassing the borrower and the judge wrote off the debt.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
