Harrassment Again - Barclaycard (Sky Card)

We've been in an IVA for 5 months now and my husband has been constantly hassled by Sky Card (Barclaycard). They refuse to speak with Payplan and have now sold the debt onto a Debt Collection Agency. We've now received a letter saying if no payment is received bailiffs then Court procedures will take place. We are obviously very worried and have again contacted Payplan who say we are to send the letter onto them and they will deal with it. We are obviously worried that nothing is done about it again and the bailiffs appear at our door. Does anyone know if it is worth sending a complaint the ombudsman?

We feel this nightmare is running on and on and we should have had relief 5 months ago when our IVA was approved!

Hi,

You have done the right thing by passing this on to your IP. This Company is bound by the IVA so they are wasting there time anyway.

Thanks Ray. I just worry that nothing is done, they said they were dealing with it last time and haven't as they said Barclaycard wouldn't speak to them, data protection and all that!

Your right though, I'll try not to worry.

It is such a pain when this happens. Payplan should deal with as you will have given them permission to speak your creditors.

If they phone up again, suggest that they check the Insolvency Register to find your name.

You have nothing to worry about at all, they are bound by the terms of your IVA and the threats are meaningless.

If they contact you again advise them that you will be notifying their regulators and your solicitor. Keep a record of anyone you speak to and the time of the call and advise them that this is harrassment and illegal.

Good suggestion of Jan's to tell them to check the Insolvency Register if they do not believe you.
