This is not the case with me. I was not on a DMP called Baines and Ernst who took details and advised me I would be best to look into an IVA and then took 2 payments before passing me onto Blair Endersby, and these payments did not go towards my IVA. These payments where far more than £70 and nearer the £500 - £700 pound mark.

As I mentioned in my email, the only way we can investigate this is if you contact me. As you can see my email has been removed due to possible spam, but my telephone number is ***telephone number removed*** and I'd be happy to take you details so we can look into this allegation. As I noted before what you suggested took place is simply not our policy. I have just realised by the way that the £70 stated in my post should actually be £100 (£70 is the average because in some cases we do not charge the full £100).

Thank you for answering so quickly.
I too was not on a DMP with Baines & Ernest - they contacted me after I filled in one of the online forms on the web site. The Advisor spent 1&1/2 hours talking to me & I clearly remember the conversation & name of Advisor.
We where adivsed to pay 370 which was 2 payments of 170 - which the advisor had worked out to be our disposable income towards an IVA, which then we where handed over to Blair Endersby. Once in the hands of BE this payment of 170 was increased to 201 for our IVA after paying 370 before the IVA started. Big difference between Gill.P & why? Whats upsetting is people whom contact firms (not just yours) are very vulnerable, scared & have little knowledge on handling debt. If I could of gone directly to BE, I think I would of liked to of been given the choice to do so.
I would be happy to email you, as its the easter holidays, I two small children running round me & its not a good time for me to phone.

Hi Nick,

I have come home, found proof of payment by calling Baines and Earnst who claim that an initial payment fee of £530 was taken on 6/10/07 at 9 am from my bank account number. Problem now is, your number is no longer displayed, how do I contact you directly. This should support all allegations!

Well I have spoken to Nick, and he drew my attention to the first letter I received from Baines Ernst which states:

From the financial information that you have provided to us during our recent telephone conversation, the Administration Payment, which was explained to you when discussing your application, is £530 and is used to cover our initial costs in collecting and reviewing your documentation and for our professional services in liasing with your creditors and the Insolvency Practitioner.

So as previously stated £530 set up fee taken.

I have just received the annual reveiw for my IVA and am concerned about how to complete it - When Baines and Ernst signed us up we were told what expediture was acceptable, and this bears no relation to what the actual cost of living is - do I just leave it as it is or do I put in the actual figures - I really don't want to rock the boat as we are doing ok with the IVA at its current level. Also how do they confirm your income - can they look at my bank account without my permission?[?]

Hi,

They cannot access your bank account and they can only go by your wage slips or bank statements.

With regards to your I & E, be as honest as you can be with your actual expenditure and that way you will not be left short.

[:D] thanks Ray, I was really worried about this as our utilities bill is certainly a lot higher than the 'allowance' of £88.00 per month they have given us and we have been juggling other things to make it work - surely they should base your payment on actual outgoings - we were given figures at the outset even though they were a lot lower than reality. Our payment is due to almost double in September when our little boy goes to school and we have lower childcare costs. On another note my husband is self employed so we have included the childcare element of our tax credits (that is all we get) in his monthly income so that we could give a regular monthly figure - his drawings go up and down based on business during the month - is this acceptable as it is part of his/our income although we did not specify its source at the time?

Hi,

Unfortunately it would seem some of these companies do not live in the real world when it comes to expenditure.

Got to be honest on your last point I am not sure but one of the experts who post on here should be able to answer for you

Fill in all details of exactly what you are currently spending (even if above the allowances) and send to your IP. You should include the child tax credit as well.

Then see what your DI is currently. Your IP will work with you and help you to sort out any problems - if necessary a Variation might be a possibility. See what your IP says first.
