Help - advice needed - so worried!!!

Need advice right know - really worried!! We had our meeting a couple of weeks ago, and because Wilson Phillips had miscalculated the amount owed to 1 creditor, they had to 'fail' the meeting - therefore, it was rejected!! Anyway, we were told that a new proposal would be raised and sent out as a priority - we have still not rec'd this!! Spoke to wilson phillips yesterday and they said we should receive it by the end of next week - therefore our new meeting date won't be until mid October!! In the mean time, we are getting more and more letters of creditors, who have now passed our debts on to agencies - 2 of these are Blair oliver and scott and Credit solutions - both of whom are calling us on a daily basis!! I have just got of the phone to a very nasty 'lady' from credit solutions (who are dealing with our debt to egg), and she has told me that, as we have not got a creditors meeting set up, she is now going to pass our file onto a balif/doorstep collector! I am so worried that a baliff is going to come and take our stuff! we have a very 'dosy' 19 year old niece living with us, that would probablly just stand there and let people take our stuff!! Please could somebody reply and let me know if these a reakistic chance of this happening - I am so stressed out at the moment with all this - help!!!!!

I suspect these are empty threats. It has been said many times on this forum that bailifs very rarely come to your house and if the do you dont have to give them acces. I think they have to get a court order which would cost them. I would say it was purely bullying tactics. Save them the time each day and perhaps ring them first and keep them updated on the progress of your case or even ask them to contact your ip. In the mean time keep pestering you ipand explain about these letters and nasty calls and ask what he/she would suggest.

I was under the impression that if you were going throught the processof an iva then you just told the companies who call,who you are dealing with & there telephone number & they have to give you some breathing space.
Thats what happened in my case any how.It was barclays that was the pest in my case i just either didnt answer my home phone at all or explained to them the situation,after doing so put the phone down.

Some collection agencies will threaten to send someone to your home if you refuse to pay them the amounts they request.

This is not a bailiff, they are simply a representative of a Debt Collecting Agency and have no powers at all. You do not need to speak to them if you do not wish to

Just try not to worry. You are doing all you can in relation to your debts. Just keep them and you IP informed.

Hi emma

Please dont worry, only a county court baliff can enter your home and remove stuff, believe me I know how scary it is to be threatened with a visit but they dont happen very often. The people who call you are from call centers, they are given a target to reach and they will say anything to you to scare you into paying them something. They dont care what your circumstances are or IVA's or anything, it does not compute in the brains on money hungry call centre staff. They are just doing their job, dont take it personally. They have you on the back foot because you owe the money, dont give them the upper hand, tell them what youre doing, tell them you cannot make a payment and hang up.

Its hard right now but it will get better, being chased and harrassed everyday is no peice of cake. Hang in there for now, we have all been there (and still are).

You can vent here at anytime.

As the others have said the only people who can enter your home are court appointed bailiffs, who must have a warrant from the court. This takes time so please don't worry.

One thing I would say is that I think the service you have received from Wilson Phillips is terrible - this is their mistake, so to have to wait as long as you have for an amended proposal seems awful.

You are doing the right and proper thing putting together an IVA. I had similar problems with persistent and occasionally nasty creditors. I informed BT that I was receiving pestering phone calls and they changed my number for free. I bought a PAYG sim card for an old mobile. I gave the PAYG mobile number to each of my creditors. All my outgoing calls are automatically withheld. I got a contact phone number for all of my creditors and called each of them every day. I told them I would not be giving them my new number due to how distressful it was for me,my wife and children, to receive multiple phone calls daily and I asked each creditor how often they wanted me to phone them. I was firm and polite pointing out I needed to protect mine and my family's mental health!! I kept them informed of the progress of my IVA. They soon became polite.

You will not get bailiffs or door step collectors,it,s all empty threats.
Get hold of your IP and tell them to get their act together,it is simply not good enough.
Be a wasp in their ear until that get that meeting arranged.
