Good point Andy - I was merely being defensive against the point that jac was making about this being the IPs prime objective. The IPs prime objective is to ensure that the IVA is supervised in the manner that is was intended to, and returns the dividend pledged. Anyone entering into an IVA has to be clear that if their circumstances improve then their creditors will expect to share some of that improvement, in lieu of the debt forgiveness they have agreed to undertake.

I don't think that is the case at all!!! Most IPs are really good and look after their people. I really don't see why they can't try and get all the money back. You go into an IVA to pay back what you owe, if possible. At least that is why we went into an IVA. Because I'm having difficulty, whether personal or financial, does not mean that IVAs or IPs are bad. I'm shocked and concerned that charities and especially legal people are telling you things like this. You are certainly being badly advised. On this forum especially the experts are fantastic and their advice sound.

It seems to be working now. However, if you still can't get through try 0161 249 5500.

I'm in a meeting from 10.30 to about 11.30 so if you ring either now or after 12 that will be best.

Hello to everyone,

Ian, I had the day from hell yesterday so didn't get to call before your meeting and then was completely headless for the rest of the day. I don't know what you did or who you spoke to but something happened - thank you. I will still call you today if I can manage, as I have to take my Dad to hospital but hope to be in work this afternoon.[V]

I can report however, that last night I got a call from my FJ consultant and she has reduced the payments and has looked back into the original IVA which stated that I was my parents carer and therefore financially responsible for them and this should have been taken into consideration. Although I am still confused [?] about some things, I now have her email address and we are going to sort this out. Although quite relieved I am still not happy but there is light at the end of the tunnel. Thanks to everyone for your valuable support and friendship and the fabulous advice from the experts.[:)]

I don't know what I would have done without you all in the last few days. My FJC also finally realised just how desperate I was getting and suddenly was very sympathetic. She was so nice - too nice perhaps as it had me in shakes and tears.[:(]

JUST HUGE AMOUNTS OF THANKS TO EVERYONE!!!! It looks as if we may now actually finish our IVA with pride.[:D]

It was nothing. One of the IPs there is a friend and former colleague of mine and I simply drew his attention to this thread. He did the rest.

So glad for you Sharon. I had to say I was surprised, I have always found Fj to be contactable and all my ac managers have been lovely. If you have any worries or problems then ring your ac manager now you have a number and email.

Not yet ... but they are on the case and have given him fourteen days to respond (from last Weds) ... and McDs solicitors have been alerted, presumably in case he doesn't respond so that they can tie things up legally. They are now addressing the issue as a variation to the IVA rather than a failed IVA (contigency debt or something?).

Yes, strangely the McD legal eagle is now saying that the Landlord should never have had the money that he got from the charging order as I was subject to an IVA ... I did try to tell everyone that at the time!! On the moral grounds that I have a responsibility to ALL my creditors I would like to see them try to claw the money back and offer the full capital raised from the re-mortgage so that all the creditors get more in the £ than they would have had under the original IVA as the action has essentially significantly preferred one creditor over the other ... I am still surprised that the Judge allowed this ... but McD think that it would cause more trouble than it would be worth to pursue it [:(]
