Hi, My husband and i have been in an IVA since April 2007 (only 11 payments left [:D])We have been so diligent with the IVA and the payments, we have contacted our IP monthly to advise them of any changes and additional monies and paid these over with no issues.
Our first relationship manager left or was promoted and since this time we have had 3 different relationship managers one of which advised us we were incredit by £634 only in March this year. This manager no longer works for the company and we have been informed that how she had reviewed the IVA was incorrect and after our 6 monthly review in april 11 we actually owe £630 due to them not allocating the additional monies correctly!!!!!
Needless to say I am NOT happy, my husband and I have done everything we can to ensure that the IVA runs smoothly, have informed them of all changes and due to their incompetence we now owe them. Now I maybe being unreasonable but my view is we pay them for a service we have done everything which we should have and could have and it is completley out of our hands, so why should we pay it??
In fairness the new relationship manager she has been nothing but apologetic and admitted it is completley their fault and no blame our side. She has said that we can either pay this at the end or split it over the next 11 months, I have advised her that I am still not happy and she has agreed to take it up with the insolvency practicioner.
I would really appreciate it if any one could tell me where we stand on this and if infact the IVA company can ask for this money when it is not our fault and completley out of out hands.
Why are they saying that you owe this money? If it is their fault then I don't see how you can liable for this.

Kallis3 - my sentiments exactly, they said it was their fault before I even challeneged them, I have to feel for the new relationship manager its not her fault either but still doesnt mean its ours. We are with Freeman Jones and up until this point they have been fantastic with no issues just hope we can sort it out asap.

I agree with the others, if they are saying it's their fault then I can't see how they can say you are liable. Did they explain what they mean by they have allocated the money incorrectly?
Every IP and their staff make the occasional mistake - I have made some howlers in the past! but no-one does this intentionally - so do give them a bit of slack here. If the money is owed, then it is owed - but they do need to give you a full explanation of your account and how the error could have arisen. You are so close to concluding this, that it would be shame to fall out at this late stage - but if I were them I would meet you half-way by reducing some of my final year's fees by way of compensation.
