Just an update. Had to ring GT just before 5.00pm tonight when I got home from work. Explained situation to someone in customer services department, who said that I needed to get back to Howard Cohen Solictors and ask them for the original agreement which was with HSBC bank to prove that the debt was in both names as as far as Grant Thornton are concerned it was in my name only. Phoned the solicitors who are apparently part of the Lewis Group who bought the debt from CL Finance who bought the debt from Metropolitan collections. This debt goes back to 1998. Howard Cohen said they have had debt since 9th October 2007, would request the paperwork but did not think they would get it so my husband is still liable and would be persued for the debt. GT say they can not add it to husbands IVA without the proof. what a nightmare. I have looked on various websites about these debt companies and apprantley there has been a lot of complaints about them and their bully tack ticks. Now got to stress over the weekend as GT now closed. Out of frustration I have been looking at GT paperwork to see if there is anything, which brings this problem to light. Just found Chairmans report of meeting of credtors for Variation in August 2010 when our IVA's were together. This variation was rejected. According to this paperwork it states that "Although Mrs Hill has been accepted, the rejection still stands as per Mr. Hill's rejecting creditors" guess what CL Finance. So obviously GT must of had the correct information that it was a joint debt but have made a mistake when separating the debts.

Forgot to add to this that I feel going bankrupt was now a waste of time. Would have £19,000 written off in my Bankruptcy now only £3,000, Obviously then taking the pressure off high payments in my husbands IVA. His IVA was for total debt of £21,000 returning 20p in the £ at £160.00 per month over remaining 35 months, now £36,000 worth of debt I can not see CL Finance accepting £160.00 per month as they originally rejected £173.00 per month. "What a B....dy mess" GT are totally responsible for this and my decision to go Bankrupt. I have never had any problems with them before always been great but this situation is not great.

Hi Florida,

What a mess! That's the clean version of what went through my mind when I read your last post!

I would escalate this to the IP direct and ask how they intend to rectify the situation.

GT should have a copy of the original credit agreement as they needed to verify it was a joint debt to include it in both your IVAs in the first place. Get them to dig it out rather than you do all the legwork!

Hi Florida - this is out of my league hun, but something is clearly very wrong & clearly that you have done nothing wrong.
I know its the weekend, but I dont want it to ruin your weekend as I think the forum Experts will be able to advise.
Keep with the forum & I will personally keep an eye on your post & make sure when a expert comes along I will "bump" it up for attention.
Do not lose hope, your in the right place & we will see you through this.

I'm sorry you're having all this worry floridaholiday - you don't need it, and these things always seem to happen at the weekend.
