I am sorry you feel that way but we are a business and our payments terms are strict. I hope you can understand that each week for the past month you have promised me a payment the following week and I have taken you at your word.



Regarding worrying about my ringing, I am here to assist clients, that is my role but you have to help me to help you. I cannot do that without payment and with your creditor meeting looming the situation has become critical. If you make a payment and the creditor meeting is accepted then you are protected from your creditors threatening or carrying out legal action, attachment of earnings etc. You have not paid them in so long as you informed me last week that you have started to receive solicitor’s correspondence. With the IVA in limbo you are still very much vulnerable to creditor’s legal action.



Again I stress that we can and will gladly hold your creditor meeting if a payment is made but if not then we will have to part company. I have listened to the call and can once again confirm that I did not put the phone down on you but will apologize if you think I was rude. That was never my intention but you do have to realize how vital regular payments in an IVA are, missing 3 payments in 5 years fails an IVA.



If you still decide not to go ahead with the creditor meeting then I wish you luck in the future and hope you get your financial situation sorted out.

I don't understand, you're not yet in an IVA so how can it fail? This doesn't make sense, why did you have to pay them money monthly before the meeting?

Hi
The fact of you making a payment or not will have no bearing on your creditors decison.
They are correct in that once the IVA is agreed you will have protection from any legal action.
It's a tough call to make,is the creditors meeting date actually set ?

what about taking it from my wages?after how long would creditors consider taking this action.

Dee I really think you need to call another debt advice company just to make sure you're clear of your options and what they mean.

To take monies out of your earnings an attachment of earnings by a court would have to be applied.

i want to go ahead with the iva i understand what it entails but when she is teleing all sorts of other things thats where it stresses me
