You will need to declare all contingent (including guarantee) liabilities within the IVA, which would be captured under the IVA if they were called upon throughout that period.

You can ask the creditor concerned to release you from your guarantee, but given that you say the company is also insolvent this must be unlikely.

An IVA will not stop you from being a Councillor generally, but do check with your local authority to see if they have a specific policy.

The Insolvency Register is a public document, and is accessible via the internet. And you may have a normal current account throughout the IVA duration.

The list of possible suppliers could be quite exhaustive. What if by mistake a personal guarantee was missed out.

Is it best to do an IVA before I do a CVA with the company

Sorry Leeroy - I cannot advise you on the last point as I do not have enough information about your circumstances. And you will need to be very diligent about your creditor list when you are putting forward an IVA and if necessary check with every supplier to see if guarantees were given.

One thing I wanted to say and I am not an expert is make sure the IVA company is sound. Check out your chosen company on IVA.Com where clients give feedback on the service they have received. One big no no is synergi as they have recieved very bad press on members of this forum.

I am sooo glad youre not thinking about the cliff as an option. I know this is hard and wish you the best, youre right though, your wife and kids would never know how much you love them. Good luck thinking of you. I do hope you will be feeling better and soon and well on the way to a solution.

Thanks for your advice.

With a secured loan against the property. This wont be in the IVA but would Lloyds call that in or just let it go on as long as they get their monthly payments regular. Would this be taken into consideration with the budget paying on the IVA
