Sounds simple to me - the debt is a creditor in the IVA and should be included to rank for a dividend payment. This is because the liability was incurred when you contracted with the claims company, which appears to be prior to the IVA being accepted. Your IP should easily be able to sort this out for you.
Thank you alr reply , I wll send a mail to my IP and see what they can do for me. I will keep you updated. I am so worried that If barclays card refund a good amount direct to my cards, I will be in the same position. I thought as they are all now in IVA payment, any money coming back to me should be send to the IP to be distributed to all creditors equally , if not this is a favoritism towards Natwest oR bARCLAYS. The claiming company got one payment directly from Virgin , they took their money and send me the balance , which I paid the IP. Also prior to the IVA I did receive payment direct to my account as I was in arrears with payment and I could have access to all account and pay the bill to the Claiming company. They couldn't confirm how each banck proceed for payment. They should know how banks works as it is their job and I did pay for each claim a charge 17 or 20 pound per claim. So they did not do this free at all. I hope that my IP can help. If not I need to find another solution .
Thanks for your support. I am getting mad, as My husband is ill now and all these things together do not help.
Rectification, I was not in arrears with any payment as I was paying the minimum to all my creditors untill I couldn't. So I had acces to the bank account to get the money to pay the fee to the claiming company.
