Sorry not been around, been very busy, anyway here is what has happened so far:

Finally had my phone call from payplan and we talked through a DMP. so far so good. I will be getting the forms etc soon.

On friday me and hubby went to see an insolvancy practioner (who was lovely) as hubbys debts are horrendous. he is also self employed and was very worried about loads of things.

after a long talk and many questions answered she looked through all our stuff, looked at my rejected iva proposal and said it was the worst she'd ever seen. we discussed BR and she said we were perfect for it. we wont lose the house due to so much neg equity and the cars should be safe as we need them for work. however in my part of wales the county courts take a couple of months to book BR dates so in the meantime we will complete the forms, I'll carry on with my dmp to stop the hassling creditors and then from april the ball will start rolling.............

huge weight off both our minds! his parents werent happy and wanted to know how we had ammassed so much debt but one of my friends who has been worried about me said congratulations!

so that is life right now.......#

Hi

We are with Payplan, the most annoying thing we have is the constant change of caseworker. Our IVA was rejected and are in a DMP with them. It is going OK but not all creditors are holding interest. I feel you have to do what is right for your own circumstances, both financial and personal.

Not an easy decision but the forum helps to level things out for me and I hope it will do the same for you.

If you are going to go BR, then I presume you will be making the court appointment pretty soon?

Even if it is a couple of months away, by the time the DMP is set up, it will be almost time for you to go to court.

Could you not use the money for the DMP to save up for your court fees?

There is no guarantee that a DMP will stop creditors hassling you anyway, as some posters on here can testify.

As payplan had all my files and paperwork they said that I had to fill out the standing order form and a payment had to be made before they could send their proposal.

Does that sound right?

actually Kallis you are making sense.................I am def going to go BR so is there a point going through a DMP right now?

That's not usual for Payplan as far as I am aware.

I have an IVA with them, and we didn't even send an upfront payment for that.

Personally, I wouldn't do a DMP for a couple of months. I'd put up with the creditors and get a court date as soon as you can.

Thanks Kallis, you are right. I havent sent off the standing order form yet so will carry on with token payments.

In the meantime what should I say to the creditors who getting quite nasty now?

You could ignore the calls, which is what I did. I dealt with everything by letter.

Otherwise, just tell them that you are in the process of trying to sort things out and will let them know when you have, then put the phone down.

You could also refuse to confirm your details when they call - they are not supposed to discuss your debt with anyone other than you and if they can't confirm who you are that should be the end of thre conversation.

Tell them you are unable to take their call as you have a severe infection which has affected your hearing - could they please write to you and communicate in writing in future as this is the only way foward ! That will delay them for a few days and before you know if your court date for BR will be here and all will be ok.

I'm now 45% through the forms..........and have a date!!! 3rd March. gulp.

I have lots of questions so will go to the BR board and ask there later this week.

If its any help - hubby just completed forms ( or at least I did with his input) his date is 9th Feb so know how you feel.

I've found this site just as helpful on BR as IVA and I know I'm amongst friends here [:)]

Have a read of Skippy's blog re:BR - very useful and re-assuring.
