Hi,Can overpaid tax credits be included in an IVA? My DMC have sent my case to an IP for review but in the meantime The Inland Revenue have stated that we were overpaid tax credits for 2008/2009 can this overpayment still be included in an IVA?If so does a representative of the Inland Revenue attend the creditors meeting and what is their position as regards IVA's?

Yes you can, no one actually attends a meeting it is all done via fax etc etc
If your tax credit overpayment have caused any future payments to be reduced then these will be recalculated and increased once the overpayment is put into an IVA.

Only if the award has been determined which is unlikely for 2008/2009. I rather think that HMRC will insist that this money is recouped by way of your future entitlements and this will obviously affect your disposable income.

You need to let your IP know about this asap.
