Hi,

I think I will be declaring myself bankrupt after all and I have phoned my local county court to ask them if there is a waiting list and they have said "no", I just need to turn up. Does this mean that if I submit my petition sometime in early March, then I should be declared bankrupt on the same day? I am trying to do this before the start of the new financial year as I would rather not have to let my empoyers know of my bankruptcy. Does this make sense and am I right in thinking that the day you turn up in court with the relevant papers and payment, this is the same day you are declared bankrupt?

Confused.

Keith

Hi Xmas Baby,

You will need to fill in the forms which can be found here

https://www.insolvencydirect.gov.uk/isolv

You take those plus the payment and you will be made bankrupt on the same date. You'll then need to have a telephone conversation with the Official Receiver who will sort out your finances with you, and decide if you have to pay anything.

You will just have to make an appointment and turn up on the day.

Most Courts operate on an appointment system and some are booked a long way in advance so I would certainly double check this if the timing is important.

Certainly as Kallis says once you are in at is all done on the day as long as your paperwork is in order.

I assume you are working on the basis that the nearer you are to 5th April the less likely you are to get a nil tax code allocated.

Best Regards
