Hi
I am currently in an IVA and have contacted the company i am dealing with to try and reduce my payments as i have have had a significant reduction in my salary, however i get no reply, should i go elswhere? i am with Clear start.

Hi there and welcome to the forum

I am afraid that once you are in an IVA it is nigh impossible to move to another company. Why not e-mail your IP directly to express your disatisfaction to the services his firm is providing.

You can find your IP's direct e-mail address on www.insolvency.gov.uk - under "Find an IP" on the homepage.

Thank you for your reply, strangely i had a phone call 2 days ago from the british association of IVA consumers, he suggested that i would proberbly be better of as a br, would you agree? not sure on my equite as house prices all over the show.

i would avoid those guys.
they are a bankruptcy assist company who will charge you in the region of £1200 for filling out simple forms and you can do your own bankruptcy for £495.
if you have problems with your ip try and resolve first rather than take a further step.

it could be that youre just talking to call centre staff-what you need is the actual ip. mel has given you the link to do that try that first but please dont waste your money with a company that will charge you extortionate money for something you can do simply yourself.
you sound very frustrated hopefully once you have managed to speak with your ip-not their staff you may be able to find a resolve. good luck we are all here for you

To answer your question Craig - you personally would have to define "better off". Bankruptcy generally brings about a lower monthly repayment, over a shorter timescale - but surely this would have been fully discussed with you at the time by your IP. Why would you be having doubts now, and if you have any assets - such as equity in a property or a car, these could be affected by bankrutpcy proceedings.

I totally agree with Fergie that you should avoid this company, and any other company like this who offer to assist you with bankruptcy. They will charge you a fortune for something you can do yourself, and as Melanie says, if you have assets, you stand to lose them if you go bankrupt.

Hi,

Beware of these companies. Because details of your insolvency is available as a public record you could be contacted by lots of companies asking if you have been missold your IVA.

We only had our IVA approved on 23/12/08 and have received 3 letters from different companies already, all claiming we can save you money etc, etc....

All of these letters went straight in the recycling, we are quite happy with our IVA, thankyou very much.

Hope you manage to resolve your issues with your IP.

Hello - we have also been contacted by a few companies via letters & phone calls. One in particlular was the British Association of IVA Consumers. Got a call of them before Christmas & they even suggested I canceled my IVA direct debit due that month! Now because of the name I got them to send me all the paper work. Which when I received it I was not impressed & there website is sometimes there & then not there!?! They asked how much my IVA was & told me to pay it to them for 6 months then I would be debt free & bancrupt. & also have to pay the 495 per person court fee! Yes I told them where to go! They even claim they can get all your money back that you paid into the IVA by proving you where missold it! Ahhh! Just wondered if any of you experts wanted me to send the paper work to you to have a look at it?
Final IVA payment made in April 2013, never ever thought we could do it or get through it but we did! X

David Mond will probably be interested. His company is Cleardebt, if you go to the website you will find contact details there.

You have definitely done the right thing there Lynsey, but I wonder how many people out there have taken them at face value and spent money they can ill afford and don't need to spend.

I very much doubt that they can get your money back for you, and if they could, how much would they cream off the top for fees first?

These firms are just jokers! Does anyone actually take them seriously? I would have thought that following the recent Court case successfully run by David Mond, that most of these firms would have stopped this ridiculous activity.

I imagine some people do take them seriously. It's a pity they can't be totally outlawed!

With my experience with just my short dealings with them - they are very pleasant (& very keen)they give you mobile numbers to keep in touch with the person that is going "to guide you through it all". But my first thought was "emmm pay you my IVA fees for 6 months?!?! & then pay 495 each (husband & I are in a joint IVA). & no longer be protected for 6 months from creditors - NOOOOOO! The name of this so called company is very very misleading.
Thanks Kallis, I knew one of the experts was interested in the paper work & I kept it for that reason.
Final IVA payment made in April 2013, never ever thought we could do it or get through it but we did! X

Another thought - they make you feel as though you where "really" missold your IVA - but I also questioned how could they know that without ever seeing your IVA proposal?!?! In the paper work they send you - they then request the IVA proposal after they have asked you to stop your payments to the IVA & pay them first?! They want the first payment with all the paper work, they even send you a payment slip! - scary.
Final IVA payment made in April 2013, never ever thought we could do it or get through it but we did! X
