Not any more Plasticdaft - it doesn't matter if you have never done anything before and are found not guilty or no charges are brought, your record remains.

Your prints probably would have been destroyed as these are just used to check against that specific job. They are not put onto the computer.

I pay about £36 p/m for buildings/contents insurance with Direct Line.. scared to change in case IVA affects the policy.. do they credit score or will it affect the policy itself..

The Rehabilitation of Offenders Act 1974 applies to all types of sentence, whether it is a term of imprisonment, a fine, probation, absolute or conditional discharge, findings in a juvenile court that an offence has been committed, and convictions of certain offences in service disciplinary proceedings.

The length of the rehabilitation period depends on the sentence and runs from the date of the conviction. When the relevant rehabilitation period has expired, the conviction becomes 'spent' and usually will not need to be disclosed in the future, for example, when you are applying for a job (unless the job is specically excluded from the act by its nature ie working with children), completing an insurance proposal form, or applying for credit facilities or a tenancy of property.

Details are retained on the Police National Computer solely for the prevention and detection of crime. If your finger prints / dna are taken they remain on the computer indefinately for the above purposes.

The insurance one is more of a grey area.... the question being 'disclosure of a material fact' - this is the term most frequently used to enable insurers not to pay claims! If the question set of the insurer includes 'Have you been in an IVA or Bankrupt' you then have a duty to answer correctly and inform the insurer if this circumstance changes.

In my experience if it is on the application form it is deemed material to either the underwriting policies, risk or pricing of the insurance product and therefor could be used not to payout when you really need them to.

Thanks Storm, you put that so much better than me!

I work within the fingerprint/dna side of things and I suppose I should be able to quote the act, but can't!

I still think that we should destroy DNA etc if the person is found not guilty or no charges are bought. It is wrong that your details are kept on the system. Plus it causes us a headache for storage!!!!!!!!!!!

On the other hand, it does sometimes help us clear up crimes which we would not normally have been able to.

I frequently have to check the prints of people who have applied for sensitive jobs, and it is amazing how many have a conviction from way back when.

Must admit that I am happy that both my fingerprints and dna are stored on the PNC (due to the nature of some of the work I do) - I do feel that as a law abiding individual I have nothing to fear.

Where I am less comfortable is the use of genetic information in adverse selection for jobs - there is a trial in the US where they look at the dna makeup of criminals to see if there are patterns that could be used to prevent people getting high risk jobs if they similar makeup.

As for storage - I have been in IT since '86 when the average computer was the size of my living room and IBM predicted the personal computer would never take off !!

It's physical storage we have a problem with. Every fingerprint form that comes into us is printed off and filed, so it doesn't take long till we need more.

I don't have a problem with my dna etc being kept, what I do object to is being given a criminal record number if I have done nothing wrong.

Just a heads up to say that I tried Confused.com and they came up trumps.

I was a bit offended when the company that contacted me was Get Ready 2 Retire or something of that ilk, but I soon got over than when the quote came in at £133 a year instead of £269 !! Cover was the same - in fact, I increased it. The only thing I don't get is no excess but Halifax dropped that part of the policy anyway.

Ang - I would suggest that if you go that route that you contact them by phone. I looked at the site and there was no little security lock at the top when you enter your details. That put me off so I came out of the site.
