Well I am down for a home visit from my bank, have a date and everything. I have to admit to being a bit scared about it but I suppose I deserve it really. I really didnt borrow the money with the intention of not paying it back. I guess this is where it begins to get stressful again, I dont know why they are calling and I have no intention of letting them in, I have offered what I can, they just havent replied. Time to get a syringe and some stones, you never know.

Hi Lily
Why would they need to visit you at home. Let them waste their time. i would just tell them that you are not giving any info on the doorstep and that any communication is to be done by letter. Dont get stressed by them. Does it have a time ? ring them and tell them its not convenient and repeat about only communicating by letter. It will all soon end for you I hope you soo deserve it.

I agree with Ang Lily. Give them a call and tell them you will not discuss anything with anyone who comes to your home and you will only communicate with them in writing.

One word of advice - I don't know if you ever gave them your new phone number but if you didn't and you give them a call make sure you withhold your number when you ring. I used to work in a call centre and the numbers show up on the phone.

Yesterday is history, tomorrow is a mystery, today is the present - a gift to make the most of.

Hi aguise

I really do not know, the time states between 9am to 9pm on the 27th. I really do not want to phone them as I have stipulated that I am not prepared to enter into a verbal discussion with them. I have tried to talk with them but they say they are not prepared to accept anything less than 90 per cent of the balance. Its usually call centre staff that I speak to who are rude and have no authority anyway. I pointed this out to the bank in a letter, everytime they say they are going to put me through to someone senior they say gives us your number and they will phone me back, which I always refuse to do. I know what the result would be, constant harrassment I just cant cope with.

I will write and confirm my offer (yet again) and mention that I will not talk to the visitor. I just think that they shouldnt be allowed to bother people and invade privacy of 'trying to pays' It will upset my kids and I do find it very upsetting myself. I have the most nosiest naighbors.

If I could go back to work I would. I cant, due to going for an operation in November.

Hi Lily
Write to them confirm the offer and say that is all you can give as you are treating all creditors fairly and to the best of your ability, that you will not talk to anybody on the doorstep as it is distressing to you and your children and you can see no need for it as they will not give their reasons for calling and iof they reqwuire a face to face meeting to discuss the offer then you will go to them.
Otherwise mate just go out ot ignore the door completely. Dont stress.

Why on earth would the bank want to visit you at home and not put everything they say in writing? And what a ridicules time scale for a visit between 9am to 9pm! This sounds like something else they will charge you for. I have found this:

Ref xxxxxxxx

Please be advised that I am only prepared to communicate with you in writing and therefore, if it remains your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).

Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property, and if you do so, then you will be liable to damages for a tort of trespass. You would also be conspiring in a trespass if you sent someone to visit me nevertheless. Should it be necessary, I will obtain an injunction.

Might just make them think…..

I would say there's an odd's on chance that noone will visit. There's an article about this in today's Guardian written by someone who is renting after a couple of poor payers and he's been opening their post because he has no forwrading address.

His predecessors were getting letters like this all the time and, as he works from home, as a journalist, he knows that noone visited.

I think that mainly it is a last ditched attempt to solicit a response.

Lily

I was told by one of the collection agencies that they would be arranging a doorstep collector to call within 48 hrs. I politely informed them that they could send them but I wouldn't have to communicate with them, never mind let them in. Needless to say nobody showed up!!

Great letter from Mike. You might want to add that you are as keen to bring this to a close as they are so if they will give you a name and contact number for somebody with the authority to discuss settling your case rather than having to keep talking to people who are paid to extract payment only this might happen sooner rather than later.

Thanks to everyone who has taken the time to reply, I really appreciate it, I just hate the thought of someone calling. I hope they do not call.

I did have a verbal discussion with them, I have a ccard a loan and a small overdraft and they said that i could pay the ccard and overdraft off in full and they would then refinance the loan with the remander, takin into account the missed payments and acrued interest, they said that were prepared to do this to help me as I had been a good customer for a number of years. However, I would struggle to make the payments on the loan and it would run for a futher eight years. I said no.

I sent the offers by recorded delivery and have replied to every letter they have sent. I cannot agree to what they are asking and they will not reply to my offer.

I also made a complaint about their harrassment and recieved a standard letter saying its being looked into, that was four months ago.

My income only consists of benefits for the forseable future.

Loved your reply Mike ... sounds like the debt collection agency letters that I used to receive when I was enetering into the IVA Lily ... just scare tactics I would imagine.

Hi lil

I also received a card in the post informing me of a visit "within the next 14 days" and the guy turned up the very next day. I did not let him in, spoke to him outside and he left.

You never know with these companies!!!

You keep fighting back Lil.

This is terrible Lily

Hope you are coping ok, its unbelievable what tactics they will try to frighten people I suppose into making a payment, It seems they dont think for a moment what effect this has on people who are already in despair. I may be under a lot of stress with the BR but at least the OR is professional, dont know how I would cope in this situation. Hope everything works out ok soon
