I didnt sleep last night, I know its a simple thing of telling them to go away but I just dont want them to come, I didnt feel quite as bad when I got up but when 8 oclock came I started to hide away in my back room. They will have recieved the letter now anyway and hopefully will reply to it.

Dont worry too much about the BR Pippa, creditors cant have what you dont have, I know its daunting but there is a whole new life just waiting for you after a rubber stamp, and for me too one day soon, hopefully.

Lilly - did you say you put a complaint in writing four months ago to them, and you haven’t had your final response from them yet? Was your complaint regarding a financial loss?

I Made a complaint about harrassment, they did reply but its not been finalised. They asked me to call about the offer I made and the girl I spoke to was rude, nasty and said I had to provide a mobile number or else and that I should be ashamed as I had signed for and agreed to pay back the loan, it was a complete and very upsetting waste of time. She also said that whatever 'grief' I was going through, I would be going through a hell of a lot more by not being able to make the agreed repayments.

There are VERY strict time limits they must adhere to as a bank they are covered by the Financial Ombudsman Service. It sounds as though they are beyond the time limit for a final response – if you wish you can take the matter further by speaking to FOS on 0845 080 1800.

Just read the leaflet - they have eight weeks to issue the final response and you have up to six months (from the date of the complaint) to take the matter up with FOS.

Well if that excuse for a human being on the end of that phone had said that to my face, I would be in prison now. I will have to find the letter they sent as it only outlined the complaints proceedure and that I would hear in due course. I will wirte back and ask whats going on. Thanks for the info Mike, Skip, not to worry, I had a back door plan but they didnt show, I did go out this afternoon though only half an hour to go now and i will be out of hiding.

The only thing is I am trying to settle the debt with them, if I do take it further would I be doing myself an injustice?? In terms of them agreeing to settle I mean, thats what I really want most at the end of the day and to put this last year well and trully in the past. It was one individual (call centre I think) and a verbal face off that I didnt record.

To be honest Lily I do not see how it can hurt your settling with them, at least they will know to treat you properly, as you know your rights, and are prepared to take it further, if they get it wrong.

However, you never know, it might just niggle the wrong person. Personally I would string them up with FOS – obviously, only you can finally decide…

I had a long hard think and another sleepness night, I have to be up again in less than 3 hours, I just need to go away and sort this mess out, its just gone on too long and I am sick of it all. If they want to meet me to have a proper discussion I will do that. I will ask about the progress of the complaint and whats been done and mention FOS, somewhere in the letter. I am also thinking about the possibility of clamining back illegal bank charges.

I wake up with the same hope that today will be the day and always end up going back to bed with the same fear. I cant lose anything more precieous than I have already lost and money cant buy it back.

The answer to my problem isnt going to be found here, but I want you to know that I am really grateful for all of the support you have all offered so willingly.

I started an IVA journey this time last year, I cant even see the tunnel never mind the light at the end of it.

hang in there lily, you will get there, you have had a long hard journey this last past 12 months, i really do hope you can get closure soon, you have made them very good offers i just wish they could sort this out for you, i know you must feel awful as your offer is on the table but they want to squeeze more and more blood from you, i really do hope you can get rid of those sleepless nights soon.

Thanks guys

I am going to try and batter the wall down, batter the doors down and batter their brains until they are sick of me. I have had so many 'fights' getting the kids educated in the correct way, getting a suitable place to live, etc. I have never felt that I have been wrong to do this. Now I have made a mess of things finacially the boots on the other foot, I did something wrong and am trying to put it right.
