hounded for a debt owed by my estranged wife

i am being hounded for a debt owed by my estranged wife. She moved out and I have no way of contacting her. The debt is £7,500 and the creditor is threatening legal proceedings against her at my address - we still own the house jointly. Can they take my house for her debt?

Hi steve and welcome to the forum

They could secure a charging order over her share of the equity, which could then be enforced if she does not pay. This would be quite extreme, but if you have any way of tracing her I suggest you try as she does need to deal with this issue.

If they get a charging order, the debt will then become secured

Could he not disassociate himself from her financial dealings?

I would assume that as the house is still jointly owned they are free to take it from her share unless the debt is paid.

I just wondered. It doesn't seem fair when she has moved out, but presumably Steve will either have to sell the house or buy out his wife's share so it would be paid back out of that.
