Whilst I was going through problems I missed more than a few mortgage payments.
I've managed to get on top of this but I incurred some litigation costs that have been added to my mortgage.
Can I include these in the iva if it's successful?

You can't include secured loans which I assume this litigation has now become.

I made the mortgage a priority at the expense of the creditors but it was necessary.
I have one creditor who's vote is required to proceed so I'm hoping they will see sense.

It's funny that this creditor was desperate to resolve the situation but is now dragging even though I'm demonstrating a solution!

I'm happy to take bankruptcy If they don't like my offer!
This would leave me with more money and them with less so it's an option that I'm happy to take if needs be!

That is good. At least the creditors know you have nothing to fear from bankruptcy so turning down your offer would be folly.

Yes its the IP in conjunction with the debtor. Someone has to pay the Court and legal fees for it though Kallis...

Please note you might have to make payments into your bankruptcy for 3 years.

Thank you Lisa - didn't realise that.

Depending on your income then the payments may be as high as those in an IVA.

The allowances can be less as well.
