Just wondering... How many holes a belt must have, or how many do you make yourself? Tighter squeeze... Oh... Ooooooh!

For those that have been following my episodes... true to form, my employer have started back-tracking some of their agreements... I am now told I cannot work those extra shifts until end of contract as they are now letting one of my Officers work his holiday... I wonder if it is because I have not taken the contract they threw at me and so looking at redundancy pay, whereas the Officer is taking the contract given him? This will mean I will be seriously down on the calculations for bridging over pay periods... hmmmmphh!

I am pleased that I am almost there with acceptance of new employer (today passed level 4 of 5), but it will be now down to the terms within redundancy clauses, and if I allow them to contact my employer for reference now, they might take it that I have found a job and then cancel the redundancy too... OR, maybe I can convince them that the reference is only an enquiry... The problem I have here is that if new job can ask for reference next week, then all being well, I would start almost immediate of my redundancy date... If I leave it until formally redundant on 1st Nov, then I will have to wait X-weeks for reference to be returned before they can give me a start date, so will mean me a couple of weeks or so out of work... It would be ok if I had money in hand and take that as vacation period, but as stands right now, I claimed recently for my vacation as PAY, but was not paid it although agreed... so... I feel a great big circle is circum-navigating itself! It is a viscious circle as I could easily just go ahead and plan new job openly and resign but lose redundancy pay, or maybe be out of work 2 or 3 weeks... I know I prefer to have the lump pay, but I am really on a needle point now as to wanting to just get things settled.

Hi Gorden

I am a tad confused why would they cancel your redundancy?

Once you have been notified about redundancy your employer should allow you a reasonable amount of time off work to seek other employment. They must support your employment applications and can not penalise you for seeking another job. This is a point of employment law.

You are correct Mike, but, if I find a job BEFORE the redundancy date, then it constitutes as resigning, and so lose entitlements to redundancy. You are exactly right and what I have already aware, but, in reality, my employer are not so forthright! ... Soooo... I will have to play this one very carefully.

What is more... although I have conducted in redundancy meeting at office on 1st October, I still have not had in writing from HR that official notice commenced... No doubt they will blame the post strike! ... until then, I wait to culmunate all details, then march forth into the abyss.

They can not assume you are resigning, well not before you give notice surely.... Although I do understand your hesitation.

Hmmm, your HR dept sounds like a right bunch of $%^***

hope you are well.

I was made redundant some years ago and found and accepted a new job before I left my current job. The new employer contacted my company for a referance and my employer was just pleased for me that I had been able to find another job so quickly and there was no problems with regard to redundancy payout.
I am no employment law legal expert, but would have thought it was illegal for an employer to say you resigned and not give redundancy package if you get a new job before you finish - as long as you don't want to finish any quicker to start new job.
My employer, as I said, was just pleased for me and eve let me go a few weeks earlier as my new employer needed me asap.
I would check into this if I were you...
Glad to hear you are getting along well with getting a new job and I will keep my fingers crossed for you that all goes well (you are certainly due for some good news, after your bad luck lately!!!!!)

Thanks... kind words in droves... I thank you and just point out, just because it is not legal, does not mean they won't try and get away with it... With my last employer, they let me go while I was off work awaiting leg surgery... A tribuneral sorted that out, but for those who are less confident will have just let them get away with it and they did sooooo many times... times fold... Although I have been there, I do not want all that hassle again... too much!

your current employers sound like a nasty bunch of crooks to put it politely!!!
Can your prospective new employer not wait to apply for the reference until you have officialy been made redundant, if you are worried? Surely you will be on some kind of 'probationary' period if you start, so they can get the reference then.

Thanks Emma, that has been discussed and the only way that they can do references after 1st Nov will still mean that it all still has to wait for paper returns... I cannot start new job until ALL paperwork and red tape complete... Bearing in mind it is a Prison I am going to, I am sure it is understandable that they want to check everything BEFORE I cross the gates.
