I had a statement from Citi-Cards one of my creditors; in spite of the fact that the DD was cancelled HSBC have paid it thus increasing an overdraft which I did not ask for. This means that one creditor has been paid and the others have not. HSBC have also taken a payment to themeselves for (1) personal loan and (2) Flexi-loan - increasing again an overdraft which they generated. I cannot access parts of the account- blocked by HSBC. I spoke to Tom at Melanie's office and he advised me to telephone HSBC - Call Centre can't (or won't) help. I have sent a message to HSBC on the message section telling them that the dd to Citi was canclled and they should not have paid it. Message Centre acknolwedged that the message has been received. HSBC have also told me, by message, to activate two new cards - one for current account and one for credit card. I have NO cards - I sent the originals back and have NOT received any new ones. I am really concerned now because my creditors meeting is on Tuesday and HSBC will say I have been operating the account and I have NOT, THEY have and Citi will say they have been paid the full minimum payment and I did not pay it - HSBC did. I have sent all the computer print outs to Tom and also the credit card statement. I feel at present this IVA is doomed to failure before it begins

Just had a call from HSBC - not very polite - I put the phone down. I really feel like chucking it all in - I cannot take anymore of this pressure. I just hope Melanie picks this up but I know she is very busy today

Hey David, not long now. Not sure if you need to be available for any reason, but I would just unplug the phone for the bank holiday weekend. Its not getting the creditors nor yourself anywhere and you don't need ot deserve the hassle. If you can't do that then just hang up the phone.

Thanks, I just hope Melanie can do something with HSBC - they are causing nothing but trouble paying things they should not be paying.I am really concerned now

Hi Elv5, dont worry I am sure Lloyds will shortly be taking money out of my account though I am at overdraft limit. Though if a Direct Debit is cancelled to another creditor by all rights they should not pay it, I believe it can take a few days for the dd to cancel so could it be that the dd came out before the computer had completely cancelled it. How did you cancel the dd ? in branch, on line or by phone?
Creditors meeting set for 2nd June....

Thanks, but my wife has seen the post - she says we should call it a day and the three of us just go - she feels HSBC will not co-operate

I have had this trouble with DDs in the past and the company can re-instate the DD at any time, even if you cancel it, this has happened to me. Were you not advised to open a new bank account unconnected to any of your creditors?

Can't think straight - forgot to answer your question - dd was cancelled on the computer and acknowledge on the computer three weeks ago now

Yes, Tina from Melanie's office advised that and we did it immediately- there is no money in the HSBC account but in spite of instructions they are operating it and getting us into a worse mess

I am confused, if it is a new account and you are not using it yet, how can there be DDs on it??

No, the HSBC account is the OLD one - they are a creditor - before I changed banks I cancelled ALL the dds on HSBC so this sort of thing, so I thought, could not happen. I could not close the HSBC account - they would not let me. No money has gone into it because it goes to the new one. HSBC are paying citi-cards and themselves and generating a large overdraft which I did not ask for nor want. They should have frozen the account as soon as they got Melanie's letter. Even with that, they did not write to Melanie but to me saying the signature Melanie sent them was not recognized yet it was the same signature they paid cheques and dds for the past 17/18 years!

Looking back, David Mond thought (on one of his posts) this behaviour could be deliberate on the part of HSBC. I hope Melanie comes on later, she may have an answer to it.

Oh, I see now, this is normal behaviour and I would not worry about if I were you.
Same thing happened to me, although I went bankrupt, I left my old account thinking it would be frozen straightaway and it wasn't, Natwest kept paying the DDs for about 3 months and there were £600 of bank charges they had put on but it was all included in the bankruptcy anyway, not my problem.

David, Please please don't worry. They are just trying it on in order for you to break and cancel the IVA. Don't worry about it as it won't make any difference whatsoever to the outcome of the IVA. Don't get upset by them and Please tell J not to worry. Forget the creditors they are just bullying you. Most important part of your life is to do all you can for J's mum. We are all with you 100% keep going and next Tuesday you will get what you truly deserve and can look forward to 5 years of IVA payments. Chin up I need you as well.

They might be increasing your debt but once your IVA is approved, it does not matter if you owe them £200 or £2000, you will just pay back what you can afford over the next 5 years.
