husbands overtime

iam one month into an iva in just my name, i know if i work any overtime i have to pay 50% into my iva but what happens if my husband does overtime does 50% of that have to go into it too,as i had to send my husbands wage slips in too and they seem to have just put both wages together took off expenditure and worked out disposable left between us and that is my iva payment it doesnt seem fair that my husband has to suffer for my debts.

Hi hallway

Your husband's overtime is his to keep. Your IP should not have taken into account overtime in the IVA proposal for either of you, but of course the 50% provision only includes extra money earned by you.

thanks when the paper work was first sent off it was going to be a joint iva so both wages were used but when the proposal was being set up they realised not enough of the debt was my husbands so just took money off for his debt repayment and put it just in my name so both our disposable income is bein paid into my iva effectivly, if he does overtime will it affect how much i have to pay next year when its my review,sorry for all these questions but its all new to me,how many of his wage slips will i have to send

I really do not see why your husband's disposable income has been included in your IVA at all - unless this was to achieve a minimum dividend. Just to reiterate any increase in your husband's income should not affect your IVA payments, and I would suggest that if you have an increase that your IP should offset that against the money your husband is effectively paying. That is what I would do!
