i am in an iva can i still go bankrupt?

melanie as i have informed the ip that my income has decreased my surplus is lower than the current monthly payments. the customer services have told me that they will have to hand the info to the tech review team this could take upto 3 months.so i could of gone into default by then couldnt i?

It's three payments you have to miss before you are in breach. If you tell your IP that you cannot manage the payments, you could always see if they would default it sooner.

i have contacted CAB ref br and got appointment to c them.Then got to contact court for paper work,so the ball is rolling towards bankruptcy.Thanks for all your help i will let you know how i get on...

Hi Peter

I do not mean to step on anones toes here, but from my personal experience of Bankruptcy advice, the CAB were not able to give full advice on this. I am also a member of the sister site regarding Bankruptcy and got more help and valuable information from them than anywhere.

They also have a helpline number that you could call, leave a message and someone WILL get back to you - this was a godsend to me in my many hours of need leading up to and after Bankruptcy.

You could also call Paul Johns at Reviva for advice. He posts on here and his details are on the experts page.

I also recommend checking out the Insolvency Service. The forms are on there and you can fill them out online and save them if you can't fill them all in at once.
