I have been in an IVA since June 11 and so far so good. At first I thought that the wolves at the door would go away now that agreements had been made but recently my bright hopes are waning due to a certain creditor still threatening to arrive at my house with their damands.
I was led to understand that this treatment would stop once in the IVA, and that such treatment was in fact illegal on their part. I am with GT who have phoned and written to them on now 3 occasions - I have copies of this correspondence - but still the damands come. I am at my wits end and now wonder if they will pursue this debt to my grave. What, if anything, legally can be done to stop this harassment and let me complete my 6yr sentence in peace. I am 64 and only in this position because of redundancy and ill health, do they not realise that if I don't make the 6yrs they will get even less.
Further I would like to say, having read all the bad press here about GT, that I have not experienced these down sides. Indeed all my calls have been either answered or called back and all emails have been receipted and answered. In short I am perfectly satisfied that GT is doing the best for me. Still further I will name and shame the creditor who still pursues me, they are APEX CREDIT MANAGEMENT who are acting on behalf of BARCALAYS PARTENER FINANCE. None of my other creditors have contacted me since the IVA date.
Threaten to report them to the Financial Ombudsman if they do not stop harrassing you. This is not acceptable behaviour and if they have been advised several times about the existence of the IVA, and they are a creditor who is bound under its terms, then they deserve to get a wallop from the Ombudsman and perhaps a fine as well.
This is really bad - so sorry that you are still getting this treatment.
Do as Mel says - they cannot legally harrass you while in an IVA and you need to get this stopped.

Contact Barclays as they are the original creditor. If they have appointed agents then they are also liable and if the debt has been sold they need to be more choosey who they sell to. You could also notify the police as it is a criminal offence to harass a debtor.

I didn't know that it is a criminal offence to harass a debtor, so will certainly keep that in mind. I was told that certain more aggresive creditors may contact you at any time during the IVA to see if they can get anything, but I would agree this needs to stop. It is bad enough being in this position without having this monkey on our backs.
Some good advice from Melanie and Michael however do not hesitate to get back in conact with GT should the contact from this creditor continue.

Thanks Karol - I did send email with attached letter from Apex on Easter Sat so am waiting for reply. I found this site same day and pleased to see you on it, tells me I'm with the right team. I will keep you informed of anything I have in progress including creditor complaints, it really is only this shower.

Hi BB - it is shocking that these creditors still feel it is acceptable to treat debtors in this way irrespective of what legal protection is in place. I guess it is the same as the law, some still feel above it. I know it means further action on your part but do whatever you need to do to report these people so they are held accountable and hopefully will be forced to amend their practises.
The OFT are very hot on harassment so they should be in the loop too. I would recommend penning a very detailed complaint letter to Apex and cc it to all of the above mentioned organisations - let them know in the letter you have copied it to all of them.
Lets us know what various responses you get and hope the poor treatment stops asap.

Thanks Tina, yet more good advice. Any further action on my part is nothing compared to the stress it gives receiving this rubbish. Detailed letters are a particular art of mine anyway so I will pen such an item and run it by GT of course. And will gladly post all here as I know I'm not the only one so if it will help anyone else being harassed in this way all the better.
