hi , i am currently in an I.V.A , how does this affect a claim from a creditor that was not included when my iva was passed? i have been sent a rather intimidating letter from a bailiff, they did send someone round a few weeks ago that took the details and contact address and number of my iva firm, they now state they are coming to remove goods, also have had one from moorcroft who are telling me they are going to apply for a bankruptcy order, i am so lost with it all, any help will be truly gratefully received

Hi amanda and welcome to the forum

Is there any reason why this creditor was left out of your IVA proposal? If this was through a genuine mistake on your part, ask your IP to invite the missing creditor to join into the IVA proceedings.

You will probably need to make additional payments at the end of the IVA to ensure the dividend originally pledged is eventually returned, but this is better than risking the whole arrangement to a bankruptcy, where all creditors will get a lot less if anything at all.
