I am totally confused, Background - I am with Clear Debt, Completed in Sept after 5 years, I no longer pay anything, Then received a letter saying it would be extended for another year due to PPI, The company they use to track PPI sent me some letters which I returned in November, I called them in December and they still hadn’t sent them off to creditors, Why did they take so long to submit these PPI claims, These have been going on for years so why not of submitted them while I was still paying into my IVA.
My main question is I spoke with my supervisor who advised that they don’t know how long it will take, A new rule means they can’t give me my certificate and regarding my credit file, Even though this September will be 6 years so Id assume everything to clear on my file (With or without a Completion certificate) they advised it will stay on my file 12 months from the date I receive my certificate, I thought by law my credit file should be cleared after 6 years? Why after waiting all this time does it stay on another 12 months from completion, Although has no issues the whole 5 years until now, I feel mislead and miss informed with all of this.
Regards
Hi Cleardebt are giving you the wrong advice regarding the IVA remaining on the credit files for 12 months after the issue of the certificate!
The IVA drops off the files 6 years from the start, provided it had been formally completed by the issue of that certificate.
If the certificate is not issued within the 6 years, but later, the IVA will drop off soon after the issue of the certificate.
Statute states that the credit file will clear withing 6 years only for entries that are no longer current, and, until that certificate is issued, the IVA is current.

Thank you:) Finally some advice, so really I need the PPI resolved by this September otherwise (when my 6 years is up) otherwise if I don't have certificate it stays on there? I can't believe that its lawful to extend an IVA over the 6 years even if I'm
Not paying, I didn't sign up for that? The PPI companies said se cases take 2 years. Obviously I'm deversated that I might not get my completion cert for another 2 years.
Have a look at your proposal -- in there are certain conditions under which they are able to extend ( at least there are in mine). If they do not give you the required notice or have run out of the time catered for in the proposal, then you are at liberty to formally challenge this.
