They just cant shrug their shoulders and say something was sent in error - they need to provide a full detailed explanation of what has occurred especially as they have admitted a mistake that has such a fundamental impact.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

I am not at all convinced that HB have got it right this time either ! At the very least you have cause to complain to their regulators to see if any disciplinary measures are appropriate.

Hopefully an expert will be able to advise further as I feel this would need professional intervention.

Hi

If your IVA failed then yes creditors can start contacting you again

You need to take advice and deal with any outstanding debt as soon as possible

Can you give further details about your IVA ?

I have replied saying it's not good enough and i want to make a complaint. What else can I do, I feel ill. It's not my error. As far as I was concerned I did all I could to mop up my mess as best I could. Is there anything else I can be doing ?

I understand that but as far as I was concerned I had paid it up. I wouldn't have paid for 5 years then default at the last minute on purpose. surely they should have contacted me to let me know. After having an email saying it was complete why would I think anything else. What iva details do you want. It was with Harrington brooks.

No nothing except the completion email. I imagine 60 months but can find out from the bank and confirm tomorrow.

I would have thought your first bet should be to write to your IP requesting the reasons why your IVA failed and a breakdown of the arrears they say you have to be sent in writing to yourself together with any explanation as to why you had not been notified of its failure.

Michelle ... just thinking out loud here, but, would you consider another IVA ( with a more reliable firm)to sort out the remaining debt and to protect the house ? It would at least give you protection from collection procedures while this mess is looked at.

Would it protect my house, I thought your house was at risk with iva ?
Whatever I do I need to sort it quick.
I am just so mad at them, I feel they're responsable for this whole mess and I am going to have to pick up the pieces again. Ruin my credit rating again and I was so proud I had turned myself around.
I have sent a complaint email asking for explanations as to why it failed, why I was contacted etc.

Another question if anyone can help. If I had to come to an arrangement with these debt collectors as a result of Harrington brooks error would it show on my credit file ?

Did you have an equity clause? If so, did you pass on the valuation and redemption certificate When you were supposed to?

The original loan was defaulted in the original IVA, they cannot default again, so it should not show up.

An IVA is designed to protect the house and allow you to raise equity if need be, whereas if you are made bankrupt the fate of the house is out of your control.
