Hi
I was in IVA agreement in 2011 and as per agreement I paid in first 12 months approx. £7000 but later found out that my IVA company staff (IP) have paid them selves out of my 12 month annuity and my creditors didn't get any thing.
Moreover, I got married and then was not able to make payments as per agreement.
Therefore, I disagree to pay any further and can cancel the agreement.
Its been 4 years & 4 months since my IVA was signed up.
and I want to apply for naturalisation/citizenship in Feb 2016!
My question to you is would it affect my citizenship application???
Many thanks
Solomon

Hi

I thought such matters would have been between the IVA company and your creditors so long as you were discharged at the end of the IVA.

As for naturalisation, if your name isn't on the insolvency register and you answer truthfully all the questions then you shouldn't have any problems.

Best wishes
*IVA started Sept 2010
*Last Payment Taken August 2015
*Completion Certificate Issued November 2015

I don't know about citizenship but cancelling an IVA after four and a half years seems madness as creditors will come after you for the balance owed. The IP is entitled to get paid and you would have been debt free early next year if all the contributions had been made.

The IP may make you bankrupt or more likely creditors will start chasing again so you should really try and sort this out with your IP.

Hi and welcome,

I agree with Michael, you should continue now until the end.

I see what you sat ST1100 but if that is the case his IVA is still open three and a half years later. It is possible but pretty slack of the IP.

Financial requirements can be found here:

See also section 6 of the following:

IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
