I entered into an IVA with Clearstart back in August 2007, this company has now been taken over by Debt Free Direct. My finacial position has changed for the worse but i am still paying the original amount. I am now 18 months into the agreement but have NOT received any review ! Are Debt Free Direct in breach of the agreement by not reviewing my position ?

Hi,

A bit strange that you have not had a review but I would advise you strongly to contact your provider and complete a revised Income and Expenditure form explaining what is affordable. They can then look at organising a variation with your creditors.

You can get your IP's details from www.insolvency.gov.uk and email them directly if you have no joy from the main staff

You should certainly have had a review by now.

I recommend that you contact them asap by using the link provided by Ray. As you are struggling with the payments, you certainly need to see about getting them reduced if possible.

If your circumstances change, don't wait for the review to come around but alert your IP straight away. Personally I would give them a call on Monday if I were you.
