Hello too much debt

On those basic figures an IVA may well work and, although I cannot say too much about it, I'm pleased to say that I have detected a positive change in NR's policy to IVA's in the last few days which may not be entirely unrelated to their own problems.

Whilst I am by no means suggesting that NR are a pushover I think that the chances of them voting positively have risen now that they have a charging order, assuming that they still will have an unsecured element of their debt and given the implied dividend of the amount that you can pay in to an IVA.

Can you list your creditors showing how much each is owed including Northern Rock (for any amount of the debt that you do not think is covered by the charging order)?

That certainly fits IVA criteria, if you choose to pursue such route. The creditors you have listed are generally supportive of IVA proposals, and you ought to be able to offer a dividend of approximately 37p in the £ which ought to be acceptable.

thank you for your reply i would like to try iva but i think the two problems are that when charging order final this will mean all my interest in house will belong to nr and i still would not be ale topay their debt off by my interest for a very long time and second i still have to get court to agree to my installments i am making to nr

The Court will have regard for your ongoing payments to Northern Rock, which are likely to be based upon a proportionate basis in line with the amounts you owe to other creditors and the disposable income you have available. The fact that your house will be fully secured to Northern Rock does not affect the IVA.

bad day to day

was my redetermination hearing at which i hoped to get installments and an end to nr's charging order. they sent solicitor from london and it ended with an installment order but also permission for final charging order hearing at beginning of jan so we could still loose our family house.

i really wanted to try iva as per recomendation from my last post but as nr is a creditor no one will take me on, really just feel totally fed up. question i need to know is as i only think br is way ahead if we do sell and rent back house our only asset jointly owned all debts in my name and i go br having given my share hopefully to all creditors equally given the restriction now registered on our house will or frown upon this when i go br as my parents are sick and they need a home to live in that is modified to their needs
