I have recently requested a full and final settlement offer from my IVA Supervisor to find one of my creditors has presented a new debt that was not included in the original IVA proposal. The Account i have been informed is a student account meaning it would need to be 8-9 years old. I do not recognise the account number and they are claiming a balance of nearly 15K. How can i get this resolved as my supervisor says they have presented details and it must be included however when i speak to the bank they cant tell me anything. Why has this only started to show up. how do i get this resolved as i am worried i have been unaware of an identity theft for some 8 years even thought this was not on my credit report a few years ago.

Hi
You need to ask your IP for full details and for the creditor to send a copy of the credit agreement that they are saying you entered into.

Hi there - this is indeed an unusal occurance. The bank will need to prove that it has been actively pursuing this debt over the last 6 years, or else it may be statue barred and therefore can be excluded from your IVA. Your Supervisor will be able to explain the legalities of this to you no doubt.
