i just dont know what to do?

I have been in an iva for nearly 2 years now. Our debt was not really that high and we personally feel now that our iva was miss sold. A debt management plan would have been better for us.We were told by the IP that they had added bits to our expenditure sheet so that we would have a bit of extra money left over at the end of the month and we should keep our heads down and we wont be bothered.

Since then we recieve 2 letters a week demanding bank statements extra money, copies of bills and all sorts. When we try and contact them they are never available and dont return calls. They set us up to fall and threaten to cancil our iva all the time. The last time we were able to spaek to a person was over a year ago. I am now pregnant much to there discust, they told me not to get pregnant as this will cause them problems.

They have also made me leave a job where my income was not as much as they wanted but it was because i was training, and at college for my career.They told me that if i did not give it up and get a job that earnt more they would cease my iva. There is not a week that goes by that i dont cry and wish we had never done this. They have effected my health and marraige and i just dont know what to do?

Im sorry that you have been treated this way, it is very unprofessional and your I.P is not doing there job by treating you like this.

For starters I dont believe anyone should think they have the right to tell another individual when to have children, Thats ridiculous! Being in an IVA and falling pregnant isn't the end of the world, all your I.P would need to do is have a discussion with you to figure out what your wages would be and how long your wages would reduce.

If your wages were to reduce for long term then a variation meeting would need to be held with your creditors, for them to accept the new disposable income.

Sounds like you are having a great service from this particular firm! I suggest that you speak directly to your IP personally and make a complaint about such atrocious behavior in his/her name.

Are you not better off going bankrupt and putting all of this behind you!

Thanks so much its nice to hear a bit of support. We have concidered going bankrupt but with a baby on the way its a scary suggestion. Its our first baby and we are in our early 20's we worked very hard to buy our house and am very scared that we will lose it and be homeless.

i have posted a review i really hope it helps people out in the future.

I will keep you posted. I have written a letter of complaint to my IP today that reads abit like an essay and i have made an app with a solicitor to find out my rights. So the ball is in there court. Fingers crossed something will be resolved.

This is disgraceful and I think you should report this case to their priofessional body.

Is there anything in writing, Natalie?

I am so sorry to hear of your awful treatment!
Congratulations on your pregnancy by the way. I really think you should try not to worry too much and concentrate on your "bump"
Have you any equity in your house? If not, then BR might be an option for you.
The forum experts might be able to give you more specific advice.

Thank you so much everyone its great to have suppport.Unfortunately we dont have anything in writing about them cheating us and adding to our income and expenditure, but every letter they have ever sent i have kept just in case.

There is no equity in my house at all, so maybe BR would be better for us. Its something we will have to look into and discuss it just sounds so scary. A family member is trying to raise some funds at the moment to try and pay this off. They have said they would accept 15k. 7k of that would be there fees, that just makes me laugh.

Just wanted to say that you need to keep your chin up as this will get sorted. Having been in a similar position myself Northern Rock not accepting my IVA I have now made the decison to go BR. I have a very young child just coming up to 20 months and I would say from a mother to a mother to be - please think about the next couple of years. You want to enjoy this special time being a mummy not worrying about paying off debts and or trying to find the money to pay off an IVA every month. You will of course know that babies are really expensive and if you don't have alot of equity in your house then you could potentially go BR and get your partner and or a family friend to buy out your BI (beneficial interest) that way you could write off most of your debt depending on what your disposable income was every month, and keep the house - obviously seek professional advice but from my experience with it and what i do know about BR it could be the right option for you. I would advise you on a personal level to get this sorted asap so you can enjoy your pregnancy (you don't want any additional worries) and then you can start afresh and look forward to the birth of your child knowing that this awful situation is sorted. Thanks you so much, its so nice to know we are not the only people that have to go through this. We were so scared about BR but now speaking to someone who is going through it at the moment has made me feel so much better.
I have sent my IP an essay basically telling them how annoyed and unproffesional they hyave been. I have also told them we are seeking advice, and have hired a solisitor. So the ball is in there court at the moment. If they do not come back with an appropraite solution, then i will go BR it cant be worse then this. Where would you recommend i go to get advice on BR?
As soon as i here of them with a reply i will let you all know straight away.
