Hiya, everyone. Me and my hubby are filing for bankruptcy today, I'm so nervous. Can't help but worry that it will not be passed, even though we have no other option as we owe far too much and not earning enough for an IVA. Please wish us luck and I'll let you all know how it goes...
It's nice to be back......

Good luck to you both, my Husband and I have been through the same thing last year, we were treated really well and with respect and weren't made to feel uncomfortable - even though I felt so ill!

Take care

Rachel

Well, we did it!!! I must admit that I'm so relieved! The court wasn't as bad as I thought, the clerk checked the forms and took the fees. She told us to go for a coffee as the Magistrate was having lunch. When we went back, we saw the magistrate, after a few questions he signed and declared us bankrupt. I had a few tears, thinking of the house, now an asset, that was our home and all the effort that had been put into it for the last 8 years, but as it has been pointed out, a house is a house, a home is where family is and for that you don't have to own it! We are now waiting for the OR to contact us, hopefully tomorrow. I just want to thank everyone on the forum for the support and advice that is given, in an honest and non-judgemental way, continue the good work.....
It's nice to be back......

Leave those questions for your wife to discuss with the Official Receiver after her bankruptcy order has been made. A lot depends upon individual circumstances, and the amount of equity you currently have in the property, but there will be no rush to make decisions immediately.

I'm glad it went ok Chris. I was the same as you - I really thought it would be worse than it actually was.
