Jane, you have come to the right place. Experts and forum members will do everything then can to help you. As far as I am aware, the Official Receiver cannot take your possessions unless they are high value - i.e. a new plasma, or a new top of the range computer etc. Bankruptcy could be an option for you to consider, especially as you are on benefits - this is money you need to live on. I am filling in my forms at the moment, to declare myself bankrupt also. D.

Mike - he was a bad boy - uninsured vehicle - history of accidents, ran up debts whilst unemployed... but he was unemployed and lived 10 miles from the nearest village , yep in the very far north, removing the car meant he had virtually no way of getting a job - he had to walk or use the post bus.
He wasnt a happy chappy at all .

He's no longer BR - working in forestry and has moved into civilisation - well a wee village.

Jane - Im BR and am with the COOP - I have found them to be very good, Cashminder account, it comes with an Electron VISA card, online banking, direct debits etc .
I also have a Virgin prepaid card - its like a mastercard but you can only use what you have paid in.. a bit like pay as u go.

the dm has just rang me i explained my fears about kepping up the payments on iva,he assured me even on benifits id get iva,also he said not everybod y get given this wonderful opportunity and why have i changed my mind as they put a lot of work into it they arranged for someone to come and see me and filled in a form!!he also sed if a few mthsdown the line ifind im struggling i can go back to my dm plan so ive got nothing to lose,he wants to give me the weekendd to think about it,i mentioned that i was thinking more along the lines of bankruptcy and he said id struggle to get a bank acc which i no is untrue as they sent me a list of bank that do accept br!!and you no it be published in local paper i told him i did no this,i felt i was speakin to a dif person then to the person i spoke to when he thought i was very keen to do it!! mind i did read somewhere that for each person they get to commit they get 5grand as a company so no doubt there on a good commision!!

Yep your details are put in the local paper and the london gazette and on the insolvency web site .. how many people that you know read the bankrupty part o the paper ?
These guy earn their money by getting IVA's - there are IP's - genuine ones - on here who come online later in the day that will give you advice - free advice.
Some of these companies use sales people rather than proper financial advisors 'cos they want your money -

What an appalling story and is part the reason that there is such bad press at times about DMP companies.
They are on one big sales push and should be ashamed of themselves.
Creditors generally will not accept people who are solely on benefits.
Bankruptcy will put all your debts behind you and you will almost certainly be able to keep your car.
No household items will be sold off and you will be able to get a bank account
Do not be pushed into a particular route until you are happy with both the facts and the company.

I cannot see what this person is talking about, I am not an expert in any sense but what is being said is down right rubbish.

Of course they get fees if you go into an IVA with them, but I very much doubt if you would be able to propose an acceptable IVA on 800 pound a month benefit income. So when the IVA is refused (probably after taking months of upfront payments) you would be put straight back on a DMP.

It makes me mad that this sort of thing is allowed to go on and some sort of regulation should exist to stop these people lying through their teeth and singing all the way to the bank. These people do not care about you Jane and are not acting in your best interests, they are only concerned with making as much money out of you as they can.

What I would say to them is not printable, rougue traders, comes to mind.

Dump them, save for your BR and move on with your life.

here are the bank acc on the list that baines and ernst sent me.these for basic bank acc andwill except undisharged bankrupts.

abbey
bank of scotland
clydesdale
co op
halifax
hsbc
lloyds tsb
nationwide
natwest
northern bank
royal bank of scotland
ulster bank
yorkshire bank

they all do dd and bank of scotland,clydesdale,co op

This sounds like another load of rubbish also, HSBC for one do not accept BR's.

Coop. nationwide and barclays have accepted BR's

Please do not do anything in haste until one of the IP's who regularly post on here give you good sound advice. Each person on this forum has different circumstances - the one common circumstance is that we are all debtors!!!! (Except the IP's of course!!!!)

I am into day 3 of by bankruptcy and agree with Lily and Mish.

I opened an account with ThinkBanking, they charge you £12.50 per month to administer your account and do no credit checks. Just be up front and honest with them and they will help you.

The only banks that will accept undischarged bankrupts are Barclays and the Co-op. Lloyds might, as they allowed me to keep my account, but I don't know if they would let you open one post-bankruptcy. Like Mish I'm with the Co-op and they are fine. I also have the Virgin pre-paid card but I can't say what it's like as I haven't used it yet!

This DMP company should be in the DOCKS!

They offer you a DMP and probably cashing in on fees as well for a year. You could have been told to do an IVA then and see if creditor will accept. If not then DMP as you have been.

DMP mis selling here. I HATE FEE CHARGING DMP COMPANIES. They are just as bad as Banks.

baines n ernst charge me 22pound a mth fees so thats over a 1000 pound in the time ive been with them
