For the last 8 weeks I've been chased by Lowell Finance for a debt of £230 which they have bought off Littlewoods. I've been in my IVA almost 4 years and I informed them of this on several occasions now and have passed the info on to my IP who have said that they've contacted them but these people will just not listen. Its now at the stage where they are going to take me to court and I politely called them today and told them again that I am in an IVA, this debt was included, and there is no point in taking me to court and then the guy said that they'll still pursue me for this debt because they have no information on my IVA and then he put the phone down.

My question therefore is should I send them all the documentation or get my IP to do this again? Also, should I continue to talk to them or just ignore the letters because no matter what I say or what info I send they don't seem to take any notice of it.

Refer to your IP, so long as the debt was originally included in the IVA.

Thanks Melanie, I'll get my IP to contact them.

Another quick question though, if Lowell have purchased the debt are they able to place a new default on the account now which will then stay on for a further 6 years? Ideally I'd like to get a mortgage and a credit card (for business use only though) in a couple of years when my credit file should be clean but if they can put another default on now it means it will still look messy for another 6 years as opposed to the 2 I have left to make 6 years from my original IVA date.

No - if the original debt was properly included then the purchaser cannot mark your credit file in any other way.

I just checked through all my paperwork and it was included in the IVA and looking at an old credit file it was defaulted just prior to my IVA being approved so I think I'll request a new credit file and see if they've entered anything on it.

I have had similar problems with littlewoods and my IVA has finished !!
Have you actually written to them ?
I have done this and it seems to have done the trick,however I would als request that your IP writes to them
