I think I am going to have to enter an IVA. I understand that I will have to go to the court and go before a judge. Please can someone advise what questions he will ask. I am very nervous!!!

Hi Sue .
As far as I'm aware you don't go to court , the Ip firm does the creditors meeting for you and the iva is registered at the court If granted . I might be wrong but I didn't attend court .
Talk to your ip about your concerns and I'm sure you'll feel much better about the whole process , plus we're all her for support :)

Sue, I have only just started my IVA and while I won't lie as I did have some worries along the way going to court was not one of them. It is all done on your behalf as mazbrown says. Good luck it is well worth the wait.

You do not attend court. The creditors vote by fax or email and send their votes into your IP's office. Once approved, the IVA is registered at your local county court.

Is your IP suggesting that you may need to apply for an Interim Order - these are generally only necessary if you need to stop ongoing legal action whilst you present your IVA proposals? In which case you may need to attend Court - but this is nothing to be scared about as in this instance you are seeking the Court's assistance, and you are therefore their "customer".

Such applications are rare these days, however it is not right to say you will not have to attend. These days IVAs are only registered at Courts if they have interim order proceedings. In cases with no interim order application, there is no filing at Court.
