I was wondering if someone could give me any advice: My father was made bankrupt between the years 1996 2001 they rekcon a total amount of £39.000 in 2003 a company came after him for the money. he remortaged his house and paid them 25000. and this should of been an end to this now in 2008 the same compnay is coming after him again for an endownment that he has on his house they want the interest out of it totaling 7000.00 but this is in joint names and they need my mom to sign it who gets half and the other half goes to them.. When will tyhis end it does not seem fair. what to stop them coming after his pension next. Please any advice would be good.

This is not unusual, the beneficial interest is not your fathers, it belongs to the official receivers office. Your father would have been advised of this when he was made bankrupt and when he was discharged.

Mike

Would the OR not have asked them at the time if there was someone who was able to purchase his BI?

Hi sadsack - I have only just dealt with a very similar situation. The OR did not offer the BK to purchase the BI, the one I dealt with was over 15 years old. He went to cash in the edowment only to find the OR had a charge lodged on it for the BI.
