No, not yet. She had the Last Rites and is hanging on - she won't go without a struggle. As I told you once Paul my Faith is strong - with my PP it has to be! One does not argue with a former chaplain to the Paras!

I'm here - just had a busy day. If a creditor does not claim in the IVA, they are still bound by its terms and cannot then pursue you outside of the arrangement.

Neverending - it that you again Andy, posting under your old name?

No, they would not be able to chase you for money after the IVA has finished, and whilst in the IVA they can't do it anyway.

I think it is unusual for a creditor not to claim though.
Apparently 3 of my creditors did not claim. I only found this out last week and I was quite surprised as there were no small amounts owing to anyone which I thought could be a reason for not claiming [:0]

Interesting Thread, so I have 5 creditors, lets say 2 don't claim and my DI would more than cover what was oweing to the 3 remaining, would my payment be lowered to just cover the 3 creditors? I don't see this happening at all as they are all companies mentioned here as ones that are persistent! MBNA, Lloyds, Northern Rock and BarclayCard, oh and Capital One

Just curious really...
Approved 3rd June 2009 first payment made on the day.

Bear in mind that your creditors don't have to put in a claim straight away, your payments will remain the one you agreed at the meeting.

Hi I am back too - been very busy.

Paul you will have no worries.

Payments into the IVA pot will remain the same whatever happens as to whether a creditor fails to agree his claim with the Supervisor. The Protocol Standard Terms explains what happens. Any creditor not submitting and agreeing theiur claim will ultimately loose out.

Thanks David,
I know I have no worries. I am just merely pointing out that if the worst does happen then br is not the end of the world. One way or another next week my debt problem will be sorted. I will be giving the IVA 110% to ensure that I will be posting in 5 years time a successful conclusion. I know you will get it through.
