Dear Sirs,
I have had an IVA in operation for over three years, but one particular creditor keeps instructing different collection agencies to pursue me for the amount owed to them, what, if anything, can I do to stop this. I notify each collection agency and pass on details of my IVA number and my supervisor, but some time later I recieve a demand from another agency.
Hi Peter. I agree with what the others say but it could be a computer generated letter sent from somewhere. Provided you are not receiving phonecalls and threats of legal action it should be nothing other than an irritant. I have found that it tends to be the smallest creditor that causes the biggest hassles and am curious if this is the case for you.
Thanks for the replies, sorry it has taken me so long to post, and yes, it is my smallest creditor causing all the hassle.
As an update, I wrote to the collection agency to inform them that the amount they were chasing is included in an IVA, but this morning I received another standard letter from theminforming me that failure to settle may result in legal action and fees and costs being added to my debt. Do I bother to reply, or just wait for the court papers and enclose a copy of my letter as a defence?
Best wishes
to all.
Peter
They cant take legal action against you. Your IVA protects you from that.
Ypu really need to get your IP to contact this company and set them straight.
There are a few posters on here who have had legal action started aganst them whilst they are in an IVA. It hasn't gone anywhere, obviously, but it is stressful.
As everyone has said, get in touch with your IP and ask them to sort it out. That's what you are paying them for!
