HI Andy,

I wonder if you can advise me. I've just had a letter from my supervisor saying ' Notice of Breach.' I am completely shocked,as I still have my house on the market and I am paying £10.00 a month as one of my supervisor's colleagues adivsed. I last spoke to them in October to keep them up to date and they said everything was fine. My supervisor's letter states that he did not authorise any deferral or change in payments, when his colleagues told me to do this and keep them posted regarding the house sale. I have emailed him a letter and posted letter too. What can I do now? Please help. Thanks

Sounds like an internal communication issue within the IP firm - do you have evidence of your discussions back in October and the name of the person you spoke to? The Supervisor has to supervise the arrangement in line with the terms of the proposal, and generally when you fall more than three payments in arrears this constitures a breach and the notice you have received needs to be served. This does not mean that the IVA cannot be varied to suit your changed circumstances, but you will need to ask your IP to call another meeting of creditors to see whether they are prepared to accept an amendment.

HI Melanie,

Thank you for your prompt reply. Yes, I do have copies of all emails and letters etc that I have received and sent. I also see that I have paid them the £10.00 per month as rewuested by them. There has been no other correspondence from them to indicate a problem with their agreement with me. I have emailed and printed off emails and sent a letter to him. I don't understamd why out of the blue they can say I have breached the agreement, when I clearly haven't. What would the possibility of re-mortgaing with the help of my mum the 30 or 29 thousand offer originally?

You really need to speak with your IP,as Melanie states they can call a variation meeting to accept your proposal and will normally give you upto a year to sell your house.You are not working so can't really look to remortgage,at the same time your creditors will surely accept your offer of selling your house because you can't maintain your IVA payments.
Again your case highlights the problems with communication in larger companies.
Get hold of your IP,and send all letters recorded.
I do hope that you have proof that the reduced payment was authorised by a staff member and embarras your IP

HI Andy,

Thnak you for your advice. I may only have a written conversation or email regarding the reduced payment. I do however, have all times and dates of conversations and replies to emails from my supervisor's colleague. The company have always been terrible at corresponding with me, even though I have sent most things through recorded delivery.
My house has only been on the market for around four months. I'll call them tomorrow. I do wish that I had chosen a different company. I suppose it's too late to change?

An email would be enough
If the worst happens an your IVA fails then ou could look for another IP to propose a full and final IVA for you based on your house sale.
Do try and get DFD to sort this one out though

Hi
You can't change IPs until your current IVA has failed,however I am sure that common sense will prevail and DFD will put forward a variation to your creditors.Try to keep focused on this and contact them each day if you have to.
I can't recommend an IP to you,I need to remain unbiased,however I'm sure that other forum members will.

Thank you very much. I sent DFD a lengthy email yesterday and will be calling them shortly. Letter is also off this morning recorded delivery!

It may take them a month to respond!!

HI Andy, I just thought I'd mention that my supervisor has still not replied to my email -I have checked and they have reeived my letter yesterday. I have wriiten him many letters for the last 5 months and never had a reply from him. Is this normal?

I said I will give them a few days to reply.

It is not normal for Supervisors not to respond to written correspondence from their clients. If this continues you ought to make a formal complaint.

My hubby was also with DFD. He tried many times to get to speak to his supervisor (Andrew Redmond)only to be told that he was a director and didnt take calls.
On advice from Melanie, we found his email address and mailed him.
Immediately hubby got a phone call, not off his supervisor but off someone who actually did know what she was talking about.
We used her email address after that and usually got a reply within 5 minutes.
Is it actually your supervisors email you have or just one for the company??
