Thanks again Mrs Skint!

Well, I have still not had a reply to my emails, letters to my supervisor sent on the 26th of January or my complaints letter sent on the 2nd of Jnauary! I can't understand it. I remember my initial IVA took around 4 to five months for them to organise, so maybe this is how they work at DFD. I am more concerned that I have had the 'Notice of Breach' out of the blue when I've kept the agreement.I'm really not sure what else I can do. I just inagine them sending a Bankruptcy petition when in fact my house could sell!

Please, is there any advice?? Very much appreciated.

If they fail to attend to your complaint letter, then you may have no choice but to file an official complaint with your IP's regulatory body. I suggest that you send them a personal e-mail, with a read and delivery receipt, advising them that unless you hear from them in the next 7 days this is precisely what you intend to do.

Thank you Melanie. I have just sent the emial to my IP, Supervisory team, head of Supervisory team and colleagues. If I don't hear anything after this, is there anything else I can?

As I said - report this to the regulatory body. They take a very dim view on unanswered correspondence, and there is little more than you can do in the circumstances.

Ok, thanks.

So basically they will not be concerned about this.. Obviously my concern is this letter I have recieved (I'm sure in error) and don't want to be made bankrupt - I was told by DFD that I am a long way off this and that the creditors would far rather receive the money from my house when sold.

HI Melanie,

I have had a reply to my email stating that I would have to report my IP from the customer services department at DFD. They have said that my complaint is being dealt with and to send all future emails to the customer care department. I'll see how long this takes!

Thanks again for your advice.

HI Andrew, Melanie anyone that can advise me please...

I wonder if you can help or advise me. I'm in a pretty desperate situation now regarding my IVA.

I had a letter from the complaints department after contacting them due to the fact my IP had not given me warning regards the reduced payment etc..

I have been given the option to remortgage or go bankrupt. They said in the letter that my supervisor was not in a position to offer me reduced payments and wait for my house to be sold. I was however, told this on numerous occassions that I can wait for my house to be sold.

I have now managed to find some work whilst I have been having treatment for my condition and may be able to look at a remortgage. Vould you please let me know if this is possible and what I need to do in order to look at raising the full and final regarding a remortgage. It is my only option now as I can't go bankrupt.

Please help.

Thank you

You would be better off talking directly to a mortgage broker who can find out exactly what would be available to you. Hopefully one of the brokers who regularly post on the forum will be able to assist.

I personally use either Andrew Graveson or Tony Parsons both of whom regularly post on the forum. You can find their details under the experts section - Andrews can be found under Brightoak and Tony Parsons posts as Welshboy.

Thank you.

I currently have a mortgage with Northern Rock and they are one of my creditors - they actually were the only ones to vote against the IVA originally. Do you think they would pffer me a remortgage(you can laugh loud!)? I have been a customer for over 3 years and have had probably two late payments with them.

My house is currently empty and I would need to get a tennant in.Can you still remortgage? I'll definately contact the above.

Thanks again.

Also, my new work (the only place to take me due to my post surgery problems after having so much time off in the UK and my family live here)is in the USA, as this is where I have been having treatment post op. Can you obtain an American mortgage for a property in England.

Why not just sell the property if you are moving to the US, and use some of the proceeds to finalise the IVA? I doubt you will get an American bank to fund a UK based mortgage in today's climate. And don't write off Northern Rock - they may well offer you a new mortgage if you ask.

HI Melanie,

My house is on the market and has been now for 5 months. DFD have said in the letter I received that I either have to remortgage pr go bakrupt. It seems thay can't wait and ovbiously didn't communicate to each other when I wrote many letters, called and emailed my Ip and numerous other people. Should they be waiting?

My mortgage stands at 78,922 and my property has been valued at 115,000.

I owe creditors around 79,000 and have paid around 5500 so far. DFD said they would probably accetp around 26000 as my original figure was 35p to the 1.00.

If I remortgage, can I get near that figure do you think even if I rent the property out?

Maybe I should approach Northern Rock.

Thanks
